Excerpt from A Treatise on the Law Relating to Municipal Corporations in England and Wales The Municipal Corporations Act, 1882, has been passed by the Legislature with the view of consolidating the Municipal Corporations Act of 1835 (5 & 6 Will. 4, c. 76), and the numerous Acts amending and extending the same. The Municipal Corporations Act, 1882, does not, therefore, affect any borough which was not subject to the provisions of the Act of 1835. It does not apply to the City of London, nor to unreformed corporations. Neither does it touch any of the following Acts, although they are administered by municipal corporations, namely: - The Public Health Acts, and the Consolidation Clauses Acts, incorporated therewith. The Labouring Classes Lodging-houses Acts. The Artizans and Labourers Dwellings Acts. The Bakehouse Regulation Act. The Acts relating to Baths and Washhouses. The Acts relating to the Adulteration of Food and Drugs. The Canal Boats, 1877. The Acts relating to Contagious Diseases in Animals. The Dogs Act, 1871. Excerpt from The Act for the Regulation of Municipal Corporations in England and Wales (5& 6 W. 4, C. 76): With an Introduction and Notes At least as early as the reign of Richard the First. (1) It is commonly said of many muni cipal corporations, that they claim to be such by prescription, a phrase which, taken strictly, imports an existence from the earliest time of legal memory, which reaches back to the reign of that sovereign; although in practice, it is intended only to imply that their origin cannot be shewn to have been at a later pe riod. The nature of their origin and growth is well expressed by Mr. Kyd, who observes, in the preface to his excellent treatise, that at their first introduction, corporations were little more than an improvement on the com munities which had grown up imperceptibly without any positive institution; and that for a considerable period, the shade which dis tinguished the one from the other, was of a touch so delicate as to require the most mi nute attention, and the most discerning eye to distinguish. (2) These observations of Mr. Kyd are made with reference to corpora tions in general, but they are particularly ap plicable to the case of municipal corporations.
