Book Description
Excerpt from A Treatise on the Law of Contracts, Vol. 1 Here I would have gladly stopped but the necessities of the practicing lawyer and the precedent of previous editions seemed to call for a summary of the law of stamps; and this I have accordingly added in a separate book, which the student, who will find in it little to reward him, can avoid. Although I have endeavored, in the manner above stated, to throw the work, so far as its principal divisions are concerned, into a somewhat more systematic and logical form, i cannot flatter myself that I have carried out my design into all the details of the work. Such a task would have required far more leisure than I have been able to find in the short interval which has elapsed since the last edition, which is now exhausted, was published. Some little I have done, and morei hope to do, if I am permitted to revise another edition; but I must trust to the indulgence of the profession to excuse many defects of which I am painfully conscious. The reader will notice that the type has been enlarged, and that the Index is no longer printed in double columns, an alteration which will be found considerably to increase the facility of using it, as it admits of easier distinction of the subjects falling under each head by variations of the marginal spaces. The head-notes of the different chapters, which, being printed in double columns and without refer ence to the pages, were quite useless, have been omitted. Book Description
Excerpt from A Treatise on the Law of Contracts, Vol. 1 of 2 The present work is intended, primarily, as a text-book for students, but it is by no means restricted in its scope or design to such a use. Its purpose is not only to sketch an elementary outline of the law relating to simple contracts, but to elucidate and systematize, as far as practicable, the general law applicable to the subject; in the hope that it may serve alike the student and the practitioner. It is believed, that such a work is now needed by the profession, for new circumstances and exigencies so modify and expand every department of jurisprudence, as to require new expositions of the law, however valuable preceding treatises may have been. The plan of the present work has been to render cases sub ordinate to principles, and, instead of pursuing the common method of merely digesting the various authorities, to throw the main body Of them into the notes, and to incorporate those only in the text, which seemed to afford the best illustrations of the doctrine under consideration. Book Description
Excerpt from Addison on Contracts, Vol. 1: Being a Treatise on the Law of Contracts The excellence of the work of Mr. Addison as a legal writer is too well established to need one word of commendation from me. His treatise upon the Law of Torts is standard authority in all of our courts, and is more often cited than any other book upon the subject. This work was prepared by him with the same care as that bestowed upon Torts, and it has always been regarded by myself as the most thorough, exhaustive, and practical work upon the subject known to the profession. I have used it almost entirely dur ing my practice, and have always found it accurate, reliable, and practical. There is but little difference in the law relating to contracts as administered in the courts of England and this country, and this work will be found as useful to American as to English lawyers. Book Description
Excerpt from A Practical Treatise on the Law Relating to the Specific Performance of Contracts A long while ago the publishers of these pages entered into an engagement with a prominent member of the bar to write a treatise on the Specific Performance of Con tracts, but his subsequent call to a different field of labor compelled him to relinquish the undertaking, and the au thor then, by request, took it up. At that time this im portant subject had not been separately treated by any American writer; and, though it occupied a place in books on the general system'of Equity Jurisprudence, yet, to obtain detailed information in. Relation to it, resort was necessarily had to English works, which, of course, did not always present the law relating to the specific enforcement of contracts precisely as it is administered by the courts of this country. The reports of every State in the Union bear abundant testimony to the practical nature and fre quent recurrence between litigants of the topics herein dis cussed; and it is the object of the present volume to give the result of our legal decisions in connection with those of Great Britain in establishing rules governing such suits.
