Eleventh Hour

Eleventh Hour PDF Author: David M. Shafie
Publisher: Texas A&M University Press
ISBN: 1623490049
Category : Political Science
Languages : en
Pages : 333

Book Description
Pres. Jimmy Carter issued last-minute rules immediately before leaving the White House, creating frustration for the incoming Reagan Administration. As George W. Bush prepared to cede the Oval Office to Barack Obama almost three decades later, he ordered more than thirty last-minute policy changes, quickly finalizing the rules before the Obama Administration could overturn them. Presidents are able to bypass Congress and quietly initiate significant policy changes by using the executive branch’s authority to alter existing statutes. In Eleventh Hour: The Politics of Policy Initiatives in Presidential Transitions, David M. Shafie analyzes how and why five successive presidents have done so at the end of their administrations, offering important new insights for the growing study of the administrative presidency. After assessing transcripts of speeches and staff communications, such as memos from the White House Domestic Policy offices, memos from selected regulatory agencies and the Office of Management and Budget, as well as records in the Clinton, Reagan, George (H. W.) Bush, and Carter Presidential Libraries, Shafie also conducted in-depth interviews with administration personnel charged with formulating and implementing the executive rule changes. Based on his research, Shafie explains end-of-term rulemaking as an instrument of presidential prerogative power by mapping its evolution through five recent presidential transitions and exploring its effectiveness, consequences, and implications. Giving consideration to recent efforts to limit interregnum rulemaking and to overturn specific late-term rules, as well as evaluating the prospects for future presidents to favor this instrument to advance their unfinished domestic policy priorities, Eleventh Hour offers groundbreaking research into the uses of executive power.

Gun Control Legislation

Gun Control Legislation PDF Author: William J. Krouse
Publisher: DIANE Publishing
ISBN: 1437941257
Category : Firearms
Languages : en
Pages : 51

Book Description
Congress has continued to debate the efficacy and constitutionality of federal regulation of firearms and ammunition, with strong advocates arguing for and against greater gun control. While several dozen gun control-related proposals have been introduced in recent Congresses, only a handful of those bills received significant legislative action. The 109th Congress, for example, passed two bills with firearmsrelated provisions that were enacted into law. P.L. 109-72 prohibits certain types of lawsuits against firearm manufacturers and dealers to recover damages related to the criminal or unlawful use of their products by other persons, and P.L. 109-295 includes a provision that prohibits federal officials from seizing any firearm from private persons during a major disaster or emergency, if possession of that firearm was not already prohibited under federal or state law. Nevertheless, the 110th Congress could possibly reconsider several gun control proposals that were considered as part of appropriations and crime legislation in the previous Congress. During the 109th Congress, the House amended the Children's Safety Act of 2005 (H.R. 3132) to prohibit the transfer or possession of a firearm to or by any person convicted of a sex offense against a minor. The House also amended Secure Access to Justice and Court Protection Act of 2005 (H.R. 1751) to authorize certain federal court judges and officials to carry firearms for personal protection. The Senate passed a different version of H.R. 1751 that included similar provisions, as well as provisions designed to clarify and expand the Law Enforcement Officers Safety Act (P.L. 108-277) -- a law that gives concealed carry privileges to qualified on-duty and retired law enforcement officers. None of those provisions were enacted into law, however. In addition, the House Judiciary considered four gun-related bills: the ATFE Modernization and Reform Act of 2006 (H.R. 5092), the Firearms Corrections and Improvement Act (H.R. 5005), the Firearm Commerce Modernization Act (H.R. 1384), and the NICS Improvement Act of 2005 (H.R. 1415). H.R. 5092 was passed by the House. The 109th Congress, moreover, maintained a fee prohibition for Brady background checks and other funding limitations and conditions related to gun enforcement in the FY2006 DOJ appropriations (P.L. 109-108). Those limitations and conditions have been continued into FY2007 under continuing resolutions. They are often referred to as the "Tiahrt amendment," for their sponsor in the FY2004 appropriations cycle, Representative Todd Tiahrt. Issues addressed in those bills, as well as the Tiahrt funding limitations and conditions, could be reconsidered in the 110th Congress. Senator Charles Schumer, for example, has introduced a bill (S. 77) that would repeal portions of the Tiahrt amendment that limit the sharing of firearm trace data. Other gun control-related issues that may reemerge in the 110th Congress include (1) retaining Brady background check records for approved transactions to enhance terrorist screening, (2) more strictly regulating certain long-range fifty caliber rifles, (3) further regulating certain firearms previously defined in statute as "assault weapons," and (4) requiring background checks for firearm transfers at gun shows. This report will updated to reflect legislative action.

Book Description
In April 2001, the Commission began an industry-wide study focused on certain aspects of generic drug competition under the Hatch-Waxman Amendments. The Amendments provide certain methods by which generic drug manufacturers can obtain approval to market a generic version of a brand-name product. The study's purpose was to provide a more complete picture of how generic drug competition has developed under one method the Amendments established: generic entry prior to expiration of the brand-name company's patents on the relevant drug product.

Unorthodox Lawmaking

Unorthodox Lawmaking PDF Author: Barbara Sinclair
Publisher: CQ Press
ISBN: 1506322859
Category : Political Science
Languages : en
Pages : 330

Book Description
Most major measures wind their way through the contemporary Congress in what Barbara Sinclair has dubbed “unorthodox lawmaking.” In this much-anticipated Fifth Edition of Unorthodox Lawmaking, Sinclair explores the full range of special procedures and processes that make up Congress’s work, as well as the reasons these unconventional routes evolved. The author introduces students to the intricacies of Congress and provides the tools to assess the relative successes and limitations of the institution. This dramatically updated revision incorporates a wealth of new cases and examples to illustrate the changes occurring in congressional process. Two entirely new case study chapters—on the 2013 government shutdown and the 2015 reauthorization of the Patriot Act—highlight Sinclair’s fresh analysis and the book is now introduced by a new foreword from noted scholar and teacher, Bruce I. Oppenheimer, reflecting on this book and Barbara Sinclair’s significant mark on the study of Congress.
