This testimony discusses the Department of Energy's (DOE) project to develop a nuclear waste repository. As required by law, DOE has been investigating a site at Yucca Mountain, Nevada, to determine its suitability for disposing of highly radioactive wastes in a mined geologic repository. On February 14, 2002, the Secretary of Energy recommended to the President approval of this site for the development of a nuclear waste repository. The next day, the President recommended approval of the site to the Congress. The President's recommendation began a statutory review process for the approval or disapproval of the site, including action by the state of Nevada, the Congress, DOE, and the Nuclear Regulatory Commission (NRC) within specified time frames. If the site is approved, DOE must apply to NRC for authorization (a license) to construct a repository. If the site is not approved for a license application, or if NRC denies a license to construct a repository, the administration and the Congress will have to consider other options for the long-term management of existing and future nuclear wastes.
