Historical Title, Self-Determination and the Kashmir Question

Historical Title, Self-Determination and the Kashmir Question PDF Author: Fozia Nazir Lone
Publisher: BRILL
ISBN: 9004359990
Category : Law
Languages : en
Pages : 500

Book Description
In Historical Title, Self-Determination and the Kashmir Question Fozia Nazir Lone offers a critical re-examination of the Kashmir question. Through an interdisciplinary approach and international law perspective, she analyses political practices and the substantive international law on the restoration of historical title and self-determination. The book analytically examines whether Kashmir was a State at any point in history; the effect of the 1947 occupation by India/Pakistan; the international law implications of the constitutional incorporation of this territory and the ongoing human rights violations; whether Kashmiris are entitled to restore their historical title through the exercise of self-determination; and whether the Kashmir question could be resolved with the formation of international strategic alliance to curb danger of spreading terrorism in Kashmir.

Murdoch and Hunt’s Dictionary of Irish Law

Murdoch and Hunt’s Dictionary of Irish Law PDF Author: Brian Hunt (Barrister-at-law)
Publisher: Bloomsbury Professional
ISBN: 9781780438955
Category : Law
Languages : en
Pages : 1920

Book Description
Murdoch and Hunt's Dictionary of Irish Law defines the principal words, concepts and phrases, their legal source, whether statutory or judicial, and gives a brief introduction to the law. Now in its sixth edition and with its definitions having been cited in the Supreme Court, this book remains essential to the understanding and practice of the law. The dictionary's usefulness lies in the wealth of related information that is pulled together under subject-matter headings. The entries are usually accompanied with the relevant statutory basis, as well as related acts and even, in the case of a major topic of law, noteworthy textbooks in the area. The dictionary draws information from a range of sources including the Rules of the Superior Courts, Law Reform commission Reports, as well as Gazette and Bar Review articles. In this way the dictionary can also be used as a subject-index of Irish law which reflects the up-to-date legislative and judicial developments in each area whilst also encompassing references to academic commentaries. The layout of the dictionary has been carefully designed with alphabetical physical tabulations and bold fonts for entry titles, to ensure the ease and speed of use. The sixth edition of Murdoch and Hunt's Dictionary of Irish Law contains over 10,300 legal definitions from “a coelo usque ad centrum” to “zoonoses”. This new edition adds 533 pages, incorporating 308 acts and 6335 SIs enacted since the 5th edition's publication eight years ago. The ongoing value of the work can be seen in the 23 instances it has been cited by the superior courts in recent years. This value will only grow in this newly expanded and updated edition.

Slavery and Social Death

Slavery and Social Death PDF Author: Orlando Patterson
Publisher: Harvard University Press
ISBN: 0674916131
Category : Social Science
Languages : en
Pages : 407

Book Description
Winner of the Distinguished Contribution to Scholarship Award, American Sociological Association Co-Winner of the Ralph J. Bunche Award, American Political Science Association In a work of prodigious scholarship and enormous breadth, which draws on the tribal, ancient, premodern, and modern worlds, Orlando Patterson discusses the internal dynamics of slavery in sixty-six societies over time. These include Greece and Rome, medieval Europe, China, Korea, the Islamic kingdoms, Africa, the Caribbean islands, and the American South. Praise for the previous edition: “Densely packed, closely argued, and highly controversial in its dissent from much of the scholarly conventional wisdom about the function and structure of slavery worldwide.” —Boston Globe “There can be no doubt that this rich and learned book will reinvigorate debates that have tended to become too empirical and specialized. Patterson has helped to set out the direction for the next decades of interdisciplinary scholarship.” —David Brion Davis, New York Review of Books “This is clearly a major and important work, one which will be widely discussed, cited, and used. I anticipate that it will be considered among the landmarks in the study of slavery, and will be read by historians, sociologists, and anthropologists—as well as many other scholars and students.” —Stanley Engerman

The Free Sea

The Free Sea PDF Author: Hugo Grotius
Publisher: Natural Law and Enlightenment
ISBN:
Category : Law
Languages : en
Pages : 184

Book Description
The freedom of the seas -- meaning both the oceans of the world and coastal waters -- has been among the most contentious issues in international law for the past four hundred years. The most influential argument in favour of freedom of navigation, trade, and fishing was that put forth by the Dutch theorist Hugo Grotius in his 1609 'Mare Liberum'. "The Free Sea" was originally published in order to buttress Dutch claims of access to the lucrative markets of the East Indies. It had been composed as the twelfth chapter of a larger work, "De Jure Praedae" ('On the Law of Prize and Booty'), which Grotius had written to defend the Dutch East India Company's capture in 1603 of a rich Portuguese merchant ship in the Straits of Singapore. This new edition publishes the only translation of Grotius's masterpiece undertaken in his own lifetime -- a work left in manuscript by the English historian and promoter of overseas exploration Richard Hakluyt (1552-1616). This volume also contains William Welwod's critque of Grotius (reprinted for the first time since the seventeenth century) and Grotius's reply to Welwod. Taken together, these documents provide an indispensable introduction to modern ideas of sovereignty and property as they emerged from the early-modern tradition of natural law. -- Back cover.
