How can we increase economic well-being and expand trade, while promoting the optimal use of the world's energy resources and protecting and preserving our shared environment? The challenge is daunting and complex. This volume of presentations and discussions from a conference on the intersection of trade, energy and the environment addresses the international or cross-border problems that arise at this intersection, the current international regulatory framework and how this framework could be improved. Institutionally, as WTO Director-General Pascal Lamy phrased it, the "core question" is "whether we need a new, more comprehensive global governance in energy" and if so, "what the form and content of such governance should be and in what institutional setting" and "what would be the WTO role in this new energy governance?" With climate change imperatives imposing different costs on carbon emissions in different countries, and trade in energy-intensive products representing a substantial part of global trade flows, trade is destined to become the "interface" between potentially otherwise disconnected national climate change regimes. One of the conference's conclusions was that the current WTO rule book offers a surprisingly large array of solutions to relatively novel energy and environment problems such as energy transit questions, import restrictions on renewable energy or subsidy disciplines applied to both fossil fuels and alternative energy. Even if these rules were not written with energy in mind, they can be applied in this new light. The big question in this respect is whether such "evolutionary interpretation" can be left in the hands of the WTO dispute settlement system (and, in particular, its seven member Appellate Body), or if it would be better handled through a political renegotiation of the agreements or explicit new rules on energy (as occurred in the EC).

Meeting the ambitious goals of the Paris Agreement will require the United States and other major greenhouse gas (GHG) emitters to integrate climate change considerations into all relevant areas of economic policy. The United States, however, has conspicuously failed to do so with regard to international trade negotiations. International trade agreements tend to increase GHG emissions due to the economic effects of trade liberalization, including increases in the scale of economic activity and changes in the composition of the affected economies. Trade agreements can also affect climate change in less quantifiable but potentially more significant ways by restricting the ability of governments to implement measures designed to mitigate climate change. Trade and investment rules in U.S. trade agreements have already been invoked to challenge a number of policies relevant to climate change, ranging from renewable energy programs to the Obama administration's decision to reject the Keystone XL pipeline. Yet despite the growing evidence of the relevance of trade policy to climate change, the Office of the United States Trade Representative (USTR) largely ignores potential climate impacts when preparing environmental reviews of proposed trade agreements as required under Executive Order 13141. This Article explores how the USTR could address climate change within the environmental review process to both assess the potential economically driven and regulatory impacts of proposed trade agreements for climate change and identify options for mitigating those impacts.

The stresses associated with climate change are expected to be felt keenly as human population grows to a projected 9 billion by the middle of this century, increasing the demand for resources and supporting infrastructure. Therefore, information to assess vulnerabilities to climate change is needed to support policies and investments designed to increase resilience in human and Earth systems. There are currently many observing systems that capture elements of how climate is changing, for example, direct measurements of atmospheric and ocean temperature. Although those measurements are essential for understanding the scale and nature of climate change, they do not necessarily provide information about the impacts of climate change on humans that are especially relevant for political and economic planning and decision making. Monitoring Climate Change Impacts tackles the challenge of developing an illustrative suite of indicators, measurements (and the locations around the globe where the measurements can be applied), and metrics that are important for understanding global climate change and providing insight into environmental sustainability. Eight panels provided input on: cryosphere, land-surface and terrestrial ecosystems, hydrology and water resources, atmosphere, human health and other dimensions, oceans (both physical and biological/chemical), and natural disasters. The book also provides an illustrative set of metrics that are likely to be affected by climate change over the next 20-25 years and, when taken together, can potentially give advance warning of climate-related changes to the human and environment systems.
