This book critically examines different forms of petroleum contracts, the historical perspective of the oil and gas industry and the political economy of the petroleum development in Iran. In doing this, the author provides analysis of the concept of concession in oil and gas development. This is discussed through the main forms of concession contracts; namely, the classic concession contract (CCC) and the new concession contract (NCC). The book ties together much of the existing work on the history of oil and gas regulation in Iran and builds on that foundation to propose a coherent and balanced approach within the framework of the NCC. To consider the role of the NCC in developing national upstream oil and gas industry, comparative examples are drawn from countries currently using, or having previously used, NCC oil and gas contracts. The selected developed and developing countries are Brazil, Thailand, the United Kingdom, Australia and Norway. The analysis considers the extent to which the NCC has served to advance the objectives and national interests of the national governments in this industry. Oil is one of the major sources of energy today and one of those activities whose benefits cut across political, economic, social and cultural realm. The benefits of oil exploitation and production depend immensely on how it is managed. The principal objective of this paper is to undertake a critical analysis of the effectiveness of upstream petroleum contracts and to improve on the principal laws that craft and regulates such contracts in Cameroon. In order to meet the objectives of the study and to address the problem, data was collected through the exploitation of secondary and primary sources of information. The methods utilized to collect secondary data were books, academic journals, magazines, oil companies' reports and official government publications. To compliment secondary data, primary data was also used and this was done essentially through interviews, focus group discussions and questionnaires. In the treatment of the data, the methodology utilized by the researcher was the critical analyses of the statutory instruments in force which regulates oil exploitation and contracts in Cameroon. After analyzing the data, the ensuring findings revealed that in spite of the contributions of oil to the national wealth of the country, it has increased environmental degradation and the exploiting communities are the most affected and they turn to benefits very little from the activities of oil exploitation. From this conclusion, the researcher strongly recommends that there should be a revision on the existing legal initiatives especially the petroleum code that regulates oil exploitation and contracts in Cameroon .This will not only ensure the effective implementation of oil contracts in Cameroon but will also influence oil companies behaviors towards more sustainable practices through regulations.

The literature on environmental regulation of the upstream oil and gas sector in developing countries and economies in transition has focused largely on domestic legislation as well as a number of intergovernmental agreements and, more recently, voluntary industry initiatives. Much less notice has been taken of environmentally relevant content of contracts negotiated between international oil companies and petroleum producing states, which often have a significant if not dominant role in shaping the regulatory regime for oil and gas operations. The only major study on this subject, carried out by Zhiguo Gao, was published in 1994. Gao concluded that environmental issues had not received enough attention in the oil and gas contracts that he had reviewed. His conclusion raises two questions, one empirical and one normative, that this article aims to explore: (1) have environmental issues received greater attention in more recent oil and gas contracts? (2) should contracting parties give further consideration to environmental issues and, if so, in what areas and through what types of provisions? A limited survey indicates that oil and gas contracts negotiated and signed in the last fifteen years generally give greater attention to environmental protection than those signed previously, but the coverage of specific topics varies widely as does the strength of terms. Additionally, concerns that certain contractual provisions may actually undermine rather than bolster environmental protection efforts have become more prominent in the period since Gao's study. Thus, there remains significant scope for oil and gas contracts to be improved from an environmental governance perspective.
