UN Territorial Administration and Human Rights

UN Territorial Administration and Human Rights PDF Author: Gjylbehare Bella Murati
Publisher: Routledge
ISBN: 1351593234
Category : Law
Languages : en
Pages : 257

Book Description
This book offers an original and insightful analysis of the human rights inadequacies that arise in the practice of UN territorial administration by analysing and assessing the practice of UNMIK. It provides arguments based on law and principles to support the thesis that a comprehensive legal framework governing the activities of the UN mission is a crucial prerequisite for its proper functioning. This is complemented by a discussion of several emerging issues surrounding the UN activity on the ground, namely, its legislative, judicial, and executive power. The author offers an extensive and well-documented analysis of the UN’s capacity as a surrogate state administration to respond to the needs of the governed population and, above all, protect its fundamental rights. Based on her findings, Murati concludes that only a comprehensive mandate can serve the long term interests of the international community’s objective to efficiently promote, protect, and fulfil human rights in a war-torn society. UN Territorial Administration and Human Rights provides a detailed critical legal analysis of one of the major UN administrations of territory after the Cold War, namely, the UN administration of Kosovo from 1999 to 2008. The analysis in this book will be beneficial to international law and international relations scholars and students, as well as policymakers and persons working for international organisations. The analysis and the lessons learned through this study shed light on the challenges entailed in governing territories and rebuilding state institutions while upholding the rule of law and ensuring respect for human rights.

The Kosovo Report

The Kosovo Report PDF Author: Independent International Commission on Kosovo
Publisher: Oxford University Press
ISBN: 0199243093
Category : History
Languages : en
Pages : 380

Book Description
The war in Kosovo was a turning point: NATO deployed its armed forces in war for the first time, and placed the controversial doctrine of 'humanitarian intervention' squarely in the world's eye. It was an armed intervention for the purpose of implementing Security Council resolutions-but without Security Council authorization. This report tries to answer a number of burning questions, such as why the international community was unable to act earlier and prevent the escalation of the conflict, as well as focusing on the capacity of the United Nations to act as global peacekeeper. The Commission recommends a new status for Kosovo, 'conditional independence', with the goal of lasting peace and security for Kosovo-and for the Balkan region in general. But many of the conslusions may be beneficially applied to conflicts the world-over.

Regime-Building

Regime-Building PDF Author: Oisín Tansey
Publisher: OUP Oxford
ISBN: 0191609773
Category : Law
Languages : en
Pages : 278

Book Description
This book is a study of regime change in the context of international administration, where the United Nations and other multilateral organisations hold temporary executive authority at the domestic level. Work on the politics of state-building has highlighted how these administration operations can influence nearly every aspect of politics in the country or territory in which they are deployed. This book concentrates in particular on the 'regime-building' practices of these missions, and examines the aims and influences of international administrations in the area of democratic development, as well as their ultimate impact on the process of regime change. Through a comparative analysis of events in Bosnia, Kosovo and East Timor, the book demonstrates how external actors assume positions of power conventionally held by domestic elites, and in so doing gain the ability to affect democratic development in ways unavailable to international actors in more conventional settings. In particular, the case studies highlight the ways in which the democracy promotion objectives of international administrators can have both positive and negative effects on democratization processes, with the presence of international authorities helping to rule out non-democratic options in some areas, while at times undermining democratic development in others. The book identifies the key international actors involved, highlights the mechanisms of influence available to them in these contexts, and explores the crucial mediating role of domestic actors and structures. Oxford Studies in Democratization is a series for scholars and students of comparative politics and related disciplines. Volumes concentrate on the comparative study of the democratization process that accompanied the decline and termination of the cold war. The geographical focus of the series is primarily Latin America, the Caribbean, Southern and Eastern Europe, and relevant experiences in Africa and Asia. The series editor is Laurence Whitehead, Official Fellow, Nuffield College, University of Oxford.

The UN and Human Rights

The UN and Human Rights PDF Author: Guglielmo Verdirame
Publisher: Cambridge University Press
ISBN: 113949676X
Category : Law
Languages : en
Pages : 511

Book Description
Through an analysis of UN operations including international territorial administration, refugee camps, peacekeeping, the implementation of sanctions and the provision of humanitarian aid, this book shows that the powers exercised by the UN carry a serious risk of human rights abuse. The International Law Commission has codified and developed the law of institutional responsibility, but, while indispensable, these principles and rules cannot on their own ensure compliance and accountability. The 'liberty deficit' of the UN and of other international organisations thus remains an urgent legal and political problem. Some solutions may be available; indeed, recent state and institutional practice offers interesting examples in this respect. But at a fundamental level we need to ask ourselves whether, judged on the basis of the principle of liberty, the power shift from states to international organisations is always beneficial.

Historical Dictionary of Kosovo

Historical Dictionary of Kosovo PDF Author: Robert Elsie
Publisher: Scarecrow Press
ISBN: 0810874830
Category : History
Languages : en
Pages : 453

Book Description
As the seventh and probably last state to arise from the ruins of the former Yugoslavia, Kosovo is the newest country in Europe. For centuries, Kosovo, also known as Kosova, was part of the Ottoman Empire, and for most of the 20th century, it was a province of what was once Yugoslavia. After the military conflict in 1998-1999 and a period of administration by the United Nations, Kosovo declared its independence from Serbia on February 17, 2008. Focusing not only on Kosovo's turbulent recent years, the second edition of the Historical Dictionary of Kosovo also relates the country's rich culture and long history. This is done through a chronology, an introductory essay, an extensive bibliography, and over 400 cross-referenced dictionary entries on significant persons, places, and events; institutions and organizations; and political, economic, social, cultural, and religious facets. This book is an excellent access point for students, researchers, and anyone wanting to know more about Kosovo.
