The use of physical restraint and seclusion on students in schools has resulted in countless injuries to both students and staff. As a result, almost every state has enacted a law to regulate restraint or seclusion use. However, news reports have continued to show those practices remain widespread in states across the country. There is a limited amount of research assessing these laws, and none have analyzed the extent to which the laws include means to ensure enforcement of the laws or to hold schools and staff accountable for following those laws. To address this research gap, a combination of legal research and qualitative content analysis examined and compared 47 state restraint and seclusion laws enacted as of July 2019. The study identified what states are legally requiring schools and staff to do regarding use of physical restraint and seclusion, and what states are including in those laws to ensure schools and staff are following them. Findings indicate that states vary drastically in their legal requirements for schools and staff regarding use of restraint and seclusion. State laws predominantly focus on the proper way to use restraint or seclusion, whereas methods to reduce restraint or seclusion use are much less prevalent. Findings also indicate that very few states include enforcement or accountability provisions in their laws. Based on the results of this study, recommendations include: (1) how laws and policies can be modified to better promote safe and minimal use of restraint and seclusion, and how to better promote adherence to the laws; (2) practical recommendations for school staff and education officials; and (3) recommendations for future research, including a potential analytical framework for assessing strengths and weaknesses of state restraint and seclusion laws.
