La libertà di espressione, libertà fondamentale del costituzionalismo moderno, è riconosciuta e garantita in tutte le Costituzioni nazionali e nelle Carte internazionali, a tutela dell’esigenza innata della persona a esprimere e diffondere il proprio pensiero. Libertà oggi in tensione alla luce delle incalzanti innovazioni tecnologiche, e in particolare del web 2.0 e dei devices di ultima generazione, che incidono profondamente sulle fondamenta del contesto giuridico. Il corpo del lavoro è dedicato alla portata delle norme che riconoscono e garantiscono la libertà di espressione rispettivamente nella Convenzione europea dei diritti dell’uomo, nella Carta europea dei diritti fondamentali e nella Costituzione italiana. Lo scopo è di porre in luce le differenze nell’estensione di tale libertà nei tre ordinamenti e nell’interpretazione fornita dalle tre Corti, quella di Strasburgo, quella di Lussemburgo e quella costituzionale italiana. L’attenzione è rivolta in particolare all’esame delle torsioni che le innovazioni tecnologiche producono sull’interpretazione delle norme con ampi riferimenti alla giurisprudenza nazionale ed europea. Partendo poi dalle criticità evidenziate in ciascun ordinamento oggetto d’indagine, lo studio tratta in modo trasversale di uno specifico bilanciamento: quello necessario ed inevitabile tra la libertà di espressione e il diritto all’onore e alla reputazione con particolare riferimento al web 2.0. A conclusione dell’opera, l’Autore propone, sulla base dei risultati raggiunti, un possibile approccio all’ipotesi della revisione delle norme oggi dedicate nella Costituzione italiana alla libertà di espressione, individuando criticità e opportunità che una tale prospettiva offre.

Nel quadro dei nuovi ordinamenti didattici universitari, può apparire fuor diluogo proporre a docenti e studenti un manuale dedicato allo studio dei dirittifondamentali delle dimensioni di quello che qui si licenzia. Sono pertanto necessariedue parole per spiegare le ragioni di una scelta non drasticamente riduttiva.La prima ragione risiede nella convinzione che, per un corso specialistico suquesto tema, sia indispensabile fornire agli studenti non solo la necessaria informazionesui principi costituzionali di riferimento, ma anche dei principali sviluppinormativi e di prassi, soprattutto giurisprudenziale, che si sono avuti neglianni che ci separano dall’entrata in vigore della Costituzione repubblicana. È ditutta evidenza, infatti, che solo da un adeguato esame di questo ulteriore profilopuò desumersi l’effettivo significato normativo delle solenni affermazioni costituzionali.La seconda ragione, di carattere più generale, risiede nella convinzione che,in questo come in altri settori del diritto positivo, un apprendimento non meramentenozionistico non possa prescindere né da una visione diacronica di regolee istituti (il che spiega il particolare rilievo che si è inteso dare all’esperienza precedentel’entrata in vigore della Costituzione), né da una loro collocazione nelpiù ampio contesto delle tendenze che vanno affermandosi al di fuori dei confininazionali (il che spiega l’ultimo capitolo, dedicato ai sistemi di tutela dei dirittidi carattere internazionale o soprannazionale). The European architecture for the protection of fundamental rights combines the legal regimes of the states, the European Union, and the European Convention on Human Rights. The purpose of this book is to analyse the constitutional implications of this multilevel architecture and to examine the dynamics that spring from the interaction between different human rights standards in Europe. The book adopts a comparative approach, and through a comparison with the federal system of the United States, it advances an analytical model that systematically explains the dynamics at play in the European multilevel human rights architecture. It identifies two recurrent challenges in the interplay between different state and transnational human rights standards-a challenge of ineffectiveness, when transnational law operates as a ceiling of protection for a specific human right, and a challenge of inconsistency when transnational law operates as a floor-and considers the most recent transformations taking place in the European human rights regime. The book tests the model of challenges and transformations by examining in depth four case studies: the right to due process for suspected terrorists, the right to vote for non-citizens, the right to strike and the right to abortion. In light of these examples, the book then concludes by reassessing the main theories on the protection of fundamental rights in Europe and making the case for a new vision-a 'neo-federal' theory-which is able to frame the dilemmas of identity, equality and supremacy behind the European multilevel architecture for the protection of human rights.
