Chacun des délits, commis par le récidiviste, encourt la peine qui lui est propre; de plus, en ce qui touche le dernier délit, c'est - à - dire ce lui qui a été commis après une condamnation, la peine ordinaire est augmentée; car, en multipliant ses méfaits malgré les avertissements qu'il a reçus, l'agent fait preuve d une perver sité qui aggrave sa culpabilité et donne lieu de craindre de nou velles rechutes, contre lesquelles la société a besoin d'une pro action plus efficace. La récidive donc deux conséquences le cumul des peines spéciales à chaque infraction; une aggro ration de peine en ce qui concerne la dernière. Cette double conséquence ne saurait ètre étendue au simple concours de plu ieurs délits ayant un auteur commun. Ce concours révèle, sans doute, de mauvaises tendances; mais l'agent, au moment où il réitère ses infractions, n'a pas encore subi la leçon d'une con damnation; il ne peut, dès lors, ètre assimilé au récidiviste qui, lui. S'insurge contre la loi, malgré les avertissements de la jus tice. Le législateur doit donc, dans l'hypothèse du concours d'infractions, écarter l'application simultanée des deux consé quences attachées à la récidive. Mais doit - il adopter l'une ou l'autre, c'est - à dire cumq les peines propres à chacune des infractions, ou bien, s'il se contente d'une peine unique, l'ag graver?
