Legal Integration and Language Diversity

Legal Integration and Language Diversity PDF Author: C.J.W. Baaij
Publisher: Oxford University Press
ISBN: 0190680806
Category : Law
Languages : en
Pages : 267

Book Description
How can the European Union create laws that are uniform in a multitude of languages? Specifically, how can it attain both legal integration and language diversity simultaneously, without the latter compromising the former? C.J.W. Baaij argues that the answer lies in the domain of translation. A uniform interpretation and application of EU law begins with the ways in which translators and jurist-linguists of the EU legislative bodies translate the original legislative draft texts into the various language versions. In the European Union, law and language are inherently connected. The EU pursues legal integration, i.e. the incremental harmonization and unification of its Member States' laws, for the purpose of reducing national regulatory differences between Member States. However, in its commitment to the diversity of European languages, its legislative institutions enact legislative instruments in 24 languages. Language Diversity and Legal Integration assesses these seemingly incompatible policy objectives and contemporary translation practices in the EU legislative procedure, and proposes an alternative, source-oriented approach that better serves EU policy objectives. Contrary to the orthodox view in academic literature and to the current policies of the EU, this book suggests that the English language version should serve as the original and only authentic legislative text. Translation into the other language versions should furthermore avoid prioritizing clarity and fluency over syntactic correspondence and employ neologisms for distinctly EU legal concepts. Ultimately, Baaij provides practical solutions to the conflict between the equality of all language versions, and the need for uniform interpretation and application of EU law.

New Approach to Legal Translation

New Approach to Legal Translation PDF Author: Susan Sarcevic
Publisher: Kluwer Law International B.V.
ISBN: 9041104011
Category : Language Arts & Disciplines
Languages : en
Pages : 326

Book Description
One of the first attempts to present a comprehensive study of legal translation, this book is an interdisciplinary study in law and translation theory. It is not bound to any specific languages or legal systems, although emphasis is placed on translation between common law and civil law jurisdictions. The main focus is on the translation of texts which are authoritative sources of the law; examples are cited primarily from statutes, codes and constitutions (Canada, Switzerland and Belgium), as well as instruments of the European Union and international treaties and conventions. Dealing with theoretical as well as practical aspects of the subject matter, the author analyses legal translation as an act of communication in the mechanism of the law, thus making it necessary to redefine the goal of legal translation. This book is intended for both lawyers and linguists, translation theorists, legal translators and drafters, legal lexicographers, as well as teachers and students of translation.

New Advances in Legal Translation and Interpreting

New Advances in Legal Translation and Interpreting PDF Author: Junfeng Zhao
Publisher: Springer Nature
ISBN: 9811994226
Category : Language Arts & Disciplines
Languages : en
Pages : 270

Book Description
This book describes interdisciplinary exploration of matters related to the translation and interpreting of legal texts. Translation of legal texts has grown exponentially since the beginning of new millennium in response to the fast-increasing volume of international trade and business as well as all sorts of other transnational activities in a myriad of spheres. International trade demands translation of trade laws and business contracts, immigration leads to rise in court interpreting services, and countries may seek to enhance their international influence through translating and making known to the world their laws and/or other legal documents. These legal translation activities occurred mostly between languages officially used in international or regional organizations, such as the United Nations and the European Union, and between the languages of major countries who exert or seek influence on international economy and law. On the other hand, rapid advances in computer technology and artificial intelligence in recent years have also brought about changes in the practices of legal translation. With changes also come problems in both theory and practice that merit our immediate attention. This edited volume highlights the newest developments in the theory, practice, and training of legal translation, with contributions from international leading researchers in this area. It will be a standard reference for anyone who is to embark on research and practice of legal translation in the twenty-first century. It is also adaptable as teaching materials for translation and interpreting training.

Research Methods in Legal Translation and Interpreting

Research Methods in Legal Translation and Interpreting PDF Author: Łucja Biel
Publisher: Routledge
ISBN: 1351031201
Category : Language Arts & Disciplines
Languages : en
Pages : 233

Book Description
The field of Legal translation and interpreting has strongly expanded over recent years. As it has developed into an independent branch of Translation Studies, this book advocates for a substantiated discussion of methods and methodology, as well as knowledge about the variety of approaches actually applied in the field. It is argued that, complex and multifaceted as it is, legal translation calls for research that might cross boundaries across research approaches and disciplines in order to shed light on the many facets of this social practice. The volume addresses the challenge of methodological consolidation, triangulation and refinement. The work presents examples of the variety of theoretical approaches which have been developed in the discipline and of the methodological sophistication which is currently being called for. In this regard, by combining different perspectives, they expand our understanding of the roles played by legal translators and interpreters, who emerge as linguistic and intercultural mediators dealing with a rich variety of legal texts; as knowledge communicators and as builders of specialised knowledge; as social agents performing a socially-situated activity; as decision-makers and agents subject to and redefining power relations, and as political actors shaping legal cultures and negotiating cultural identities, as well as their own professional identity.
