Book Description
"WAI 2662. The claimants were several Whakatōhea groups, and they objected to the Crown's recognition of the Whakatōhea Pre-Settlement Claims Trust's deed of mandate. That mandate was for the negotiation of Whakatōhea's historical Treaty of Waitangi claims. The central complaint was that the Crown had breached the principles of the Treaty by failing to actively protect the claimants' ability to exercise their rangatiratanga and decide for themselves how they would settle their historical claims. The report looks at whether the Crown's decision to recognise the claims trust's deed of mandate was fair and reasonable and made in good faith. The Tribunal found that the Crown had failed to act reasonably, honourably, and in good faith and had thus breached the Treaty principles of partnership and active protection"--Publisher information.

The Ngapuhi Mandate Inquiry Report PDF Author: New Zealand. Waitangi Tribunal

Languages : en
Pages : 96

Book Description
"The Ngapuhi Mandate Inquiry Report is the outcome of an urgent Waitangi Tribunal inquiry into 15 claims submitted by Ngapuhi groups (including hapu and hapu collectives) concerning the Crown's decision to recognise the Tuhoronuku Independent Mandate Authority as having secured a mandate to enter negotiations with the Crown to settle the historical claims of all Ngapuhi. The claims alleged that the Crown's decision was flawed and reflected its desire to settle all Ngapuhi historical Treaty claims through a single settlement process regardless of the preferences of Ngapuhi hapu. They argued that, in recognising the mandate secured by the Tuhoronuku Independent Mandate Authority, the Crown had failed to actively protect the ability of Ngapuhi hapu to exercise their rangatiratanga in determining when and how they would settle their claims"--Publisher information.

The Priority Report on the Whakatōhea Settlement Process PDF Author: New Zealand. Waitangi Tribunal

Book Description
"Whakatōhea are an eastern Bay of Plenty iwi. They have endured some of the worst historical breaches of the Treaty of Waitangi, including war and raupatu (land confiscation). The failure of an attempt to settle Whakatōhea's Treaty claims in the 1990s has left a legacy of division, which was in part reflected in the claims brought before the Tribunal in 2017 concerning the Whakatōhea Pre-Settlement Claims Trust's mandate. The tribunal found that the Crown's recognition of that mandate was in breach of Treaty principles, and it therefore recommended that Whakatōhea be given a chance to vote on the way forward. Following the vote, the Crown resumed negotiations and offered Whakatōhea a parallel process, in which negotiations with the Crown would occur alongside the Tribunal's historical inquiry. In 2020 and 2021, the Tribunal received further applications for an urgent hearing on these matters. This report is the result of a rapid priority inquiry into the conditional offer of the parallel process, outstanding issues in respect of the withdrawal mechanism, and the role of hapū in the ratification process" -- book cover.

The Waitangi Tribunal

The Waitangi Tribunal PDF Author: Janine Hayward
Publisher: Bridget Williams Books
ISBN: 1877242624
Category : History
Languages : en
Pages : 367

Book Description
The Waitangi Tribunal sits at the heart of the Treaty settlement process, with a unique remit to investigate claims and recommend settlements. But although the claims process has been hugely controversial, little has been written about the Tribunal itself. These essays, by leading academics, lawyers and researchers, successfully fill that gap, examining the Tribunal’s role in reshaping Māori identity and society, the Tribunal’s future mission, and its contribution to ideas of justice and reparation. This perceptive analysis of a key institution is vital reading for anyone seeking to understand Treaty settlements.
