A Report of the Debates and Proceedings in the Secret Sessions of the Conference Convention PDF Author: L. E. Chittenden
Publisher: Good Press
ISBN:
Category : Fiction
Languages : en
Pages : 909

Book Description
A Report of the Debates and Proceedings in the Secret Sessions of the Conference Convention by L.E. Chittenden is a report recording the Virginia Secession Convention of 1861. This convention was called in Richmond to determine whether Virginia would secede from the United States, govern the state during a state of emergency, and write a new Constitution for Virginia, which was subsequently voted down in a referendum under the Confederate Government. Excerpt: "If I had been guided by my judgment alone it is not probable that these notes of the debates in the Conference, held upon the invitation of Virginia, at Washington, in February 1861, would have been made public. From the commencement of its sessions, a portion of the members was in favor of the daily publication of the proceedings."

Book Description
Excerpt from Official Report of the Proceedings and Debates of the Convention Assembled at Salt Lake City on the Fourth Day of March, 1895, to Adopt a Constitution for the State of Utah Mr. Van horne. Mr. Chairman and gentlemen' of the Convention, as the mover of the motion, it becomes my duty to speak to the question of whether it shall prevail or not. You have heard an argument against the motion. With you will rest the ques tion of whether it is right, whether it is just, Whether it is equitable, and whether it is legal, that that motion shall prevail. To begin with, I will say that so far as I. The mover of the motion, ' was actuated, I made that motion with a full adherence and a full recognition of the solemn oath I took on becoming a member of this Convention. I made the motion and I adhere to the motion with a full consciousness that I am sworn to uphold the Constitution of the United States; that I am, by im plication, sworn to do only such things as I think to be legal, to be right, to be equitable. No purpose other than the purpose that the people who have ex premed their preference for delegates to this Convention shall have that expres sion recorded in the form of the dele gates they sent here. No other motive than that the whole people of Utah shall be recognized in this Convention is in my mind in making that motion. The gentleman says that only upon the permanent organization does this become a Convention; that we are dilly dallying with the question from day to flay in order to seat certain men. Mr. Van horne. I understood the gentleman that way. I may have been mistaken. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Building International Investment Law PDF Author: Meg Kinnear
Publisher: Kluwer Law International B.V.
ISBN: 9041161414
Category : Law
Languages : en
Pages : 778

Book Description
This volume celebrates the first fifty years of the International Centre for Settlement of Investment Disputes (ICSID) by presenting the landmark cases that have been decided under its auspices. These cases have addressed every aspect of investment disputes: jurisdictional thresholds; the substantive obligations found in investment treaties, contracts, and legislation; questions of general international law; and a number of novel procedural issues. Each chapter, written by an expert on the chapter’s particular focus, looks at an international investment law topic through the lens of one or more of these leading cases, analyzing what the case held, how it has been applied, and its overall significance to the development of international investment law. These topics include: - applicable law; - res judicata in investor-State arbitration; - notion of investment; - investor nationality; - consent to arbitration; - substantive standards of treatment; - consequences of corruption in investor-State arbitration; - State defenses - counter-claims; - assessment of damages and cost considerations; - ICSID Arbitration Rule 41(5) objections; - mass claims, consolidation and parallel proceedings; - provisional measures; - arbitrator challenges; - transparency and amicus curiae; and - annulment. Because the law of international investment continues to grow in importance in an ever globalizing world, this book is more than a fitting way to mark the past fifty years and to welcome the next fifty years of development. It will prove both educational for practitioners new to the field and informative for seasoned investment lawyers. Moreover, the book itself is a landmark that will be of great value to professionals, scholars and students interested in international investment law.
