The Supreme Court of Canada has ruled that the drawing of provincial electoral boundaries is subject to one of the democratic rights in the Canadian Charter of Rights and Freedoms: the right to vote. This paper discusses questions that arise with respect to electoral boundaries and the context of the democratic theory of representation by population. It reviews a Supreme Court of Canada case ruling on the extent of permissible deviation from the one person/one vote principle; presents comments on representation of rural versus urban voters, on population criteria for ridings, and on approaches to electoral redistribution. The paper then reviews other court decisions in cases involving the constitutionality of provincial boundary redistributions and case law concerning other sections of the Charter. The paper concludes with an outline of possible future court challenges regarding electoral redistributions.
