The paper applies standard public choice reasoning to the negotiations on EU enlargement and the Treaty of Nice. The starting point is the assumption that accession can only be successfully completed if the interests of decisive actors in present EU countries are respected. Decisive actors in the West are the members of the European Parliament, individuals in national governments and in the Commission. Personal costs and benefits of these individuals are analysed with respect to enlargement. Furthermore, the basic strategic issues of the negotiations are depicted that arise from the different pre-entry and post-entry position of new members. The Intergovernmental Conference is reinterpreted as an opportunity of EU-15 actors to protect their personal interests in an enlarged Community. The relative attractiveness of the 13 official candidate countries is assessed on the basis of some indicators that emerge as important from the political-economic approach. The paper concludes by giving some cautious forecasts about likely outcomes of both the Treaty of Nice and the accession bargaining.

EU member nations must decide whether to ratify the Nice Treaty. This report, written to inform these decisions, is highly critical of the Treaty but argues that it should be passed since it is 'repairable' and rejecting it would delay Eastern enlargement. It proposes two 'emergency repairs' to the Treaty. The authors marshal the best available empirical evidence and analytic techniques to show that the Treaty fails to meet its goal of adjusting EU decision-making to the realities of a Union with 27& members. Far from maintaining the EU's ability to act after enlargement, the authors argue that the Nice reforms reduce EU27 decision-making efficiency below what it would have been with no reform. Unless the Treaty is mended, future integration will be guided by intergovernmental initiatives in which large members play a large role due to their economic dominance. The Treaty also fails to resolve the ECB's 'numbers problem' - enlargement without reform would also damage the ECB's decision-making capacity. The Treaty does include an 'enabling clause' to help solve this problem: the report analyses the possible solutions and proposes specific reforms.

In May 2004 the European Union will undergo the largest expansion in its history when ten countries -- Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia, and Slovenia -- become members. The number of new members and their diversity make this "big bang" enlargement particularly challenging. Not only do these countries vary widely in language, culture, and geography, but also their per capita income is less than half that of existing members. EU officials believe that expanded integration will serve the EU's objectives of peace, stability, prosperity, and democracy; but the less abstract questions of costs and benefits of enlargement are more complex.
