A Treatise on the Law of Crimes (Classic Reprint)

A Treatise on the Law of Crimes (Classic Reprint) PDF Author: William Lawrence Clark

Category : Law

Book Description
Excerpt from A Treatise on the Law of Crimes The scope of the original work has not been enlarged or chan ged in any manner. Neither has any attempt been made to vary the original classification except the addition of a very few, and perhaps inconsequential, sections to the sub-analysis. An effort has been made to preserve the original text so far as possible. At the same time the revisor has not hesitated to make such changes as the decisions warrant. Some considerable matter has been added by way of elucidation whenever such seemed advisable. It is believed that every criminal case decided since the is anauco of the original edition has been examined. Those mere ly cumulative have been rejected, but the aim has been to pre serve every case which serves in any manner to aid the student in understanding the principles. Few, if any, cases can be said to lay down new principles, but many adaptations of the old principle to new states of fact have been found. These illustrative, novel cases have been carefully and fully pre sented. H. B. L. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. The Law of Crimes and Criminal Procedure, Including Forms and Precedents (Classic Reprint) PDF Author: Lewis Hochheimer
Publisher:
ISBN: 9781331044147
Category : Law
Languages : en
Pages : 634

Book Description
Excerpt from The Law of Crimes and Criminal Procedure, Including Forms and Precedents This work is designed to present in a compendious form the law of crimes and criminal procedure as established in the United States and administered in the state and national tribunals. It is intended to contain a complete statement of the common law, including such statutory enlargements and modifications as are of general application. Mere commentary and discussion have been avoided, the aim being to give in terse paragraphs an explicit statement of the existing law. Verbiage and needless repetition have been carefully guarded against, and the author has been solicitous, that his work throughout should be characterized by thorough accuracy and clearness. Where there is a conflict of ruling and opinion, he has cited the opposing authorities, or referred to authorities giving the opposing views, but has never hesitated to state as law in positive terms what appeared to him to be the correct doctrine according to the weight of reason and authority. The utmost care was observed in the matter of the citation of authorities with a special view to avoiding, not only inaccurate and wrong references, but more particularly the great evil of the useless and embarrassing multiplication of citations. The work is divided into four parts. Part first ("law of crimes in general") presents the general doctrines of the substantive criminal law and includes chapters on the subjects of "statutes and statutory construction" and "constitutional guaranties and limitations." Part second relates to "criminal procedure," state and Federal. A special effort has been made to present this subject thoroughly in all its divisions and details. This part contains the law relating to criminal jurisdiction, pleading and evidence and the numerous topics falling under the general head of "practice." It also contains forms adapted to the various stages of criminal proceedings. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Handbook of Criminal Law (Classic Reprint) PDF Author: William Lawrence Clark Jr

Category : Law

Pages : 596

Book Description
Excerpt from Handbook of Criminal Law IN preparing a new edition of Mr. Clark's book, no depar ture from the original plan of the author has been made. The book is intended, as explained in the preface to the first edi tion, to contain a concise, but full, statement of the general principles of the criminal law, exclusive of criminal proce dure, which has been made the subject of a separate volume in the Hornbook Series by the same author. The editor has incorporated much new matter, which has necessitated chang es in the original text, and has made other changes which were suggested to him by a use of the book in the classroom. Many additional cases, most of them reported since the first edi tion, but some of them earlier leading cases, have been cited. Criminal Law, Vol. 1

Criminal Law, Vol. 1 PDF Author: Percy Bordwell
Publisher: Forgotten Books
ISBN: 9780656291557
Category : Law
Languages : en
Pages : 84

Book Description
Excerpt from Criminal Law, Vol. 1: Instruction Paper If the party defrauded is also guilty of a violation of the law, he, too, should be prosecuted, rather than his offense should serve as a shield to the other's crime. The offense is committed against the public, and not against the individual. The guilty party is prosecuted in the interest of the people of the state, and not in the interest of the party defrauded of his property. There is no principle of law that will bar the state from prosecuting a criminal because some other person is a particeps criminis. Race, Crime, and the Law

Race, Crime, and the Law PDF Author: Randall Kennedy
Publisher: Vintage
ISBN: 0307814653
Category : Social Science
Languages : en
Pages : 559

Book Description
An "admirable, courageous, and meticulously fair and honest book” (New York Times Book Review) in which “one of our most important and perceptive writers on race" (The Washington Post) takes on a highly complex issue in a way that no one has before. "This book should be a standard for all law students."—Boston Globe In this groundbreaking, powerfully reasoned, lucid work that is certain to provoke controversy, Harvard law professor Randall Kennedy takes on a highly complex issue in a way that no one has before. Kennedy uncovers the long-standing failure of the justice system to protect blacks from criminals, probing allegations that blacks are victimized on a widespread basis by racially discriminatory prosecutions and punishments, but he also engages the debate over the wisdom and legality of using racial criteria in jury selection. He analyzes the responses of the legal system to accusations that appeals to racial prejudice have rendered trials unfair, and examines the idea that, under certain circumstances, members of one race are statistically more likely to be involved in crime than members of another.
