This bill is the result of the joint project undertaken by the Law Commission and HM Land Registry in 1996, to update and reform the system of land registration. The principal current legislation dates back to the Land Registration Act 1925, and although subsequent amendments have improved the machinery of conveyancing, the principles and definitions of the underlying law had been found to be obscure and confusing. The key objective of the Bill is to establish an effective legal framework in which all registered conveyancing will be conducted electronically within a few years, by providing for a secure electronic communications network. This reform is expected to lead to major improvements for those involved in the three million property transactions which take place in England and Wales every year. The Bill also includes proposals for a new scheme to provide greater protection for the interests of registered proprietors against squatters. It proposes changes to current legislation regarding 'overriding interests'; and contains provisions for the Land Registry to provide a new consultancy and advisory service, and for the creation of a new system of independent adjudication of disputes.
