Excerpt from Year Books of the Reign of King Edward the Third: Years XII and XIII Apart from the value of the year-books as law re ports, they illustrate, or can be made to illustrate, not only what is generally known as legal and constitutional history, but the actual effect of the laws and constitu tion in operation. They show, or can be made to show, not only what the law was, and what use was made of it by Judges and Counsel, but much also of the social condition of the litigants, and even of persons who were not litigants at all. The end which has been kept in view in editing and translating the reports in the present volume has been to render them accurate, by deriving as much aid as possible from every source of informa tion connected with them. The object of this Intro duction is to explain the method which has been adopted, and to indicate some of the very important facts which either the reports themselves or the records which supply their deficiencies may be brought to reveal. The year-books, too, are sources of philological in formation quite swi generis. They are not only a great storehouse of the French language as used in England, but (subject to the errors made by the various tran scribers) they also exhibit that language as employed in every day speech by the most highly educated English men of the period. Excerpt from Year Books of the Reign of King Edward the Third: Years XVII. And XVIII In one instance the transposition may, at first sight, appear to have been somewhat arbitrarily made. A passage standing in the old editions as the conclusion of No. 112 of Michaelmas Term 17 Edward III. (which is in fact a second report of No. 25) has now been transferred to the end of the second report of No. 21, which appears in the old editions as No. 108 (bis). It relates to the interval allowed for an adjourn ment, in cases of Quare impedit, by the Statute of Marlborough, c. 12. As No. 25 is a case of Quare impedit, and No. 21 is a Quare incumbmrit, it may, perhaps, be asked why the passage should not be re garded as belonging really to No. 25 rather than to No. 21. The answer is that it is absolutely incon sistent with the pleadings in No. 25. In that case there was no pleading to issue on the facts, and no jury called, or to be called. In No. 21, however, there was an issue, and the county from which the jurors had to be summoned was Cornwall, as the church of Kilk hampton, to which the Quare incumbravit has reference, is in that county. Counsel is represented as com plaining that the day which had been given, according to the entry of the clerk upon the roll, was at a shorter interval than was allowed by the Act; and to enforce his argument he said the place from which the jury will come to try that issue. Is in the most foreign county in England. By the expression most foreign he, no doubt, meant the county which is the most remote from Westminster, and from his point of View it was not an unapt description of the county which includes the Land's End. Excerpt from Year Books of the Reign of King Edward the Third: Years XIII and XIV As it happens, however, many of these identifications by inference have been put to the proof in a manner not anticipated at the time when they were made. The Harleian ms. 74-1 frequently shows the names of the parties even when it contains a very short report or mere abridgment of the case. The names were added from the roll before this ms. Was consulted, and, when after wards a comparison was made, it was found that in no instance had the identity of the cases been mistaken. It appears, therefore, to be beyond doubt that assistance may be obtained from the records even where the search for it may, at first sight, appear hopeless. There are, of course, many reports or short notes which are not com parable with the records, because they deal only with some isolated point of practice, or embody some generali sation. A full report of an important case in the Common Pleas, however, can almost always be traced upon the roll, if sufficient pains be taken. The only real exception to this general rule is where the case is reported as of one term and entered upon the roll as of another. This does sometimes happen where the names are given in the report, and when consequently the fact is suscep tible of proof. It also happens, in all probability, some times where the names are not given in the report, but it would then be imprudent to assert that the subject matter of a report and of a record is the same.
