The judiciary act of 1789, in addition to the fixing of the membership of the Supreme Court, giving it a Chief Justice and five associate justices, created thirteen district courts which were grouped into three circuits; the Eastern circuit (comprising the districts of New Hamp shire, Massachusetts, Connecticut, and New York), the Middle Circuit (comprising the districts of New Jersey, Pennsyl vania, Delaware, Maryland and Virginia), and the Southern circuit (comprising the districts of South Carolina and Georgia) Maine and Kentucky were districts which were not included in either of the circuits.
