What is meant by "effets publics" (government securities)? There is no legal definition as to what securities may be thus termed. We can only refer to authors. We refer to Volume IV of the Traite de Droit Commercial of MM. Lyon-Caen & Renault.0 "In the category of 'effets publics, '" they say, "are reckoned the securities issued by the duly constituted authorities (especially the rentes of the French Government or of foreign Governments, securities issued by the departments or townships, French Treasury bonds, which form the floating debt, etc.), or issued by permission of the authorities (shares and bonds of railroad companies, shares and bonds of corporations created with the authority of the Government by virtue of article 37 of the Code de commerce). On the other hand, similar securities issued by private corporations, not subject to preliminary authorization, are not "effets publics." (10) What is meant by the words "and others susceptible of being quoted?" The words "and others susceptible of being quoted," which appear in article 76 of the Code de commerce, have given rise to several interpretations. a No. 890. MM.
