First, the development of the question in Maryland is carried down from the earliest times to the end of the royal government. Here, as the colony' grows, we see the development of a legal system, twisted out of natural progress by peculiarities of the Maryland palatinate govern ment. Then, leaving the discussion of Maryland, we trace brie y the legal doctrine declared by English judges and law yers, the value of which, for purposes of comparison, is equaled only by the information derived from! The experience of'other colonies, parts of which receive some discussion. Next, the reader is brought back to the legislative history of the) dispute, in the decade 1722-1732, and in the later phases to the present time. The narrative part of the work thus con cluded, we turn to the more interesting consideration of the arguments in the debate, as exhibited in certain important documents. Lastly, inquiry as to the total effect of these arguments in their relation to English and American colonial history leads us to a resume and conclusion. Excerpt from A Treatise on the Maryland, Simplified, Preliminary Procedure and Pleading, in Courts of Law In the performance of the duty, laid upon my col leagues and myself by the General Assembly of Maryland, of simplifying the Practice and Pleadings in the Courts of the State, it was assigned to me. with other work, to simplify the Pleading in the Courts of Law. As, therefore, I am the author of the system of Simplified Pleading, some of my professional brethren, in different parts of the State, have persuaded me to write this treatise for the benefit of the student, and perhaps the assistance of the practitioner, of the law. As therefore the treatise has not been obtruded upon the profession, but yielded at the solicitation of some of its ablest members, it deserves to receive the greater indulgence for its many imperfections. And while many of its defects are, doubtless, ascribable to my incompetency, I beg, that some be attributed to the short time I have had to prepare the work: not having had as many weeks, as I ought to have had months, for the labor. But the necessity for its immediate use would not allow me more time for its preparation. It will be observed, that I have rarely referred to authorities, in my exposition of the doctrines of Pleading. This, it seemed to me, was best, for a book which is designed, to present the system of Pleading in its new aspect, embarrassed, as little as possible, by the old ideas which a look into authorities will necessarily recall into the mind. If any statement of doctrine be deemed erroneous, the enlightened practitioner will know where to find the authorities to correct my error.
