European Works Councils and Industrial Relations

European Works Councils and Industrial Relations PDF Author: Jeremy Waddington
Publisher: Routledge
ISBN: 1136913491
Category : Business & Economics
Languages : en
Pages : 382

Book Description
The creation of European Works Councils is arguably the most important measure taken in global industrial relations in recent years. Adopted with the primary goal of facilitating European-level workers’ participation in information-sharing and consultation in multinational companies, EWCs have also been central to a wide-ranging process of institution-building at the European level. European Works Councils charts the growth in the number of EWCs and the development of practices associated with EWCs between 1994, when legislation on EWCs was adopted, and 2009, when the initial legislation was amended. Drawing on original, large-scale, survey data, the book shows that the quality of information and consultation is generally poor, thus bringing into question the soft touch legislative approach to employee participation of the European Commission. The reforms implemented within trade union organizations to accommodate the development of EWCs are explored, together with the initiatives taken to extend the role of EWCs beyond information and consultation to incorporate negotiation. Articulation between EWCs and trade union organizations is shown to be integral to EWCs as institutions of information and consultation, and as a means to influence managerial decision-making. Similarly, the development of EWCs is shown to be a process contested by employers’ organizations and managers on the one hand and labour organizations on the other. The character of this contestation ensures that the category ‘EWC’ includes a wide range of institutional forms and practices.

Dictionary of European actors

Dictionary of European actors PDF Author: Elisabeth Lambert Abdelgawad
Publisher: Primento
ISBN: 2804481719
Category : Law
Languages : en
Pages : 406

Book Description
If the European political space has been extensively explored, research has remained all too often focused on the institutions of the European Union and the Council of Europe rather than on the actors who make Europe. This dictionary brings a new angle to scholarship on Europe by systematically investigating its actors: those who work within the institutions or in close contact with them; those who are the targets of European policies; those in the name of whom reforms are carried out; those who promote Europe and those who oppose it. It showcases a comprehensive, interdisciplinary approach that bridges the usual separation between the European Union and the Council of Europe. In each entry, contributors selected among the leading specialists in their fields of research present the state of the art and the most current research perspectives on European actors. Students, teachers and researchers with an interest in Europe will find this volume to be a valuable work of reference and a source of new and stimulating ideas and perspectives on Europe. More broadly, the dictionary will appeal to ‘professionals of Europe’ eager to gain insights into their working environment as well as to readers interested in understanding Europe through its actors.

A Legal Analysis of NGOs and European Civil Society

A Legal Analysis of NGOs and European Civil Society PDF Author: Piotr Staszczyk
Publisher: Kluwer Law International B.V.
ISBN: 9403512520
Category : Law
Languages : en
Pages : 471

Book Description
Amid widespread awareness and discussion of “the democratic deficit” and “shrinking civil space,” the role of nongovernmental organizations (NGOs) becomes increasingly important. Yet the precise legal status of such bodies is ill-defined. Here, for the first time, is a thorough commentary and analysis of the position of NGOs and European civil society in the European Union (EU) constitutional system, bringing to the fore existing and desirable means of public participation in EU lawmaking. Recognizing that NGOs have historically been designed to meet the ends of civil society, the analysis focuses on the following topics and issues: means in EU law of advocating for the collective interests of civil society; unofficial means of influencing the EU institutions; access to documents and the European Citizens’ Initiative as means of exerting pressure on EU legislation; relations between the EU institutions and NGOs, including lobbying activities; bringing actions in the common good before courts and other institutions; the special role of NGOs in environmental protection; complaints to the Commission and the European Ombudsman; EU funding for NGOs; and transboundary philanthropy. Drawing on a broad spectrum of sources of law, including CJEU case law and relevant legal literature, the book offers insightful proposals leading to the democratization of the EU’s internal procedures that will allow enhanced cooperation of civil society representatives across national borders. In its thorough examination of legal tools that can respond to the “democratic deficit,” this book makes a distinctive contribution to the public debate on the future of the European Union, especially in the context of emerging threats to further integration. It will prove of great value not only to civil activists, academics and policymakers but also to everyone interested in European integration and affordance for social participation.

Fundamental Rights in EU Internal Market Legislation

Fundamental Rights in EU Internal Market Legislation PDF Author: Vasiliki Kosta
Publisher: Bloomsbury Publishing
ISBN: 1782258973
Category : Law
Languages : en
Pages : 466

Book Description
This book attempts to systematise the present interrelationship between fundamental rights and the EU internal market in the field of positive integration. Its intention is simple: to examine the way in which, and the extent to which, fundamental rights protection is realised through EU internal market legislation. To that end, the analysis is conducted around four rights or sets of rights: data protection, freedom of expression, fundamental labour rights and the right to health. The book assesses not only what substantive level of protection is achieved for these fundamental rights, but it also estimates whether there is a 'fundamental rights culture' that informs current legislative practice. Finally, it asks the overarching question whether the current state of harmonisation amounts to a 'fundamental rights policy'. The book offers a much more varied picture of the EU's fundamental rights policy in and through the EU internal market than perhaps initially expected. Moreover, it builds the case for a more conscious approach to dealing with and enhancing fundamental rights protection in and through internal market legislation, and advocates a leading role for the legislature in the establishment of an internal market that is firmly based on respect for fundamental rights.
