Excerpt: ...Among the taxable subjects enumerated in the first section of the Act of 1891 are "loans secured by bonds or any other form of certificate or evidence of indebtedness." It is not only mortgages and moneys owing by solvent debtors, whether by promissory note, bond orjudgment, that are taxable, but also loans secured by judgments or mortgages, which are embraced in the comprehensive language of " bonds or any other form of certificate or evidence of indebtedness." We are of the opinion that Hamlin & Sons, bankers, should have made return ' to the proper assessor of McKean county of the judgment notes and mortgages held by them and paid a tax of four mills thereon for the year 1896 to the treasurer of the county or the person thereto authorized, for and as a State tax; that the county of McKean, by its proper otiicers, should have included the same in its return and statement to the board of revenue commissioners, and collected and paid into the State treasury the amount of said tax on said personal property, and failing so to do, it is directed that judgment be entered for the sum of $767.05 in favor of the Commonwealth and against the defendant county, if exceptions are not filed as provided by law. While we have very serious doubts as to our jurisdiction in any case of this kind, we have no doubt that we have no jurisdiction in this particular case, because some of the parties who owned the property and made the sale thereof are sui juris, and the only reason why the aid of this court was invoked was because the interest of these minors had to be conveyed in order to make the title complete. Clearly we have no jurisdiction over those of full age, and as the remedy is a joint one, which cannot well be severed, the proceedingsshould be in a court that can take jurisdiction of all concerned.
