Most examinations of non-citizens in Canada focus on immigrants, people who are citizens-in-waiting, or specific categories of temporary, vulnerable workers. In contrast,Producing and Negotiating Non-Citizenship considers a range of people whose pathway to citizenship is uncertain or non-existent. This includes migrant workers, students, refugee claimants, and people with expired permits, all of whom have limited formal rights to employment, housing, education, and health services. The contributors to this volume present theoretically informed empirical studies of the regulatory, institutional, discursive, and practical terms under which precarious-status non-citizens – those without permanent residence – enter and remain in Canada. They consider the historical and contemporary production of non-citizen precarious status and migrant illegality in Canada, as well as everyday experiences of precarious status among various social groups including youth, denied refugee claimants, and agricultural workers. This timely volume contributes to conceptualizing multiple forms of precarious status non-citizenship as connected through policy and the practices of migrants and the institutional actors they encounter.

“The TFW Program was created in 1973 to allow employers to hire foreign nationals to fill gaps in their workforces on a temporary basis. The program has grown and been updated over the years to respond to Canadian labour market conditions. However, employers and temporary foreign workers have expressed long-standing concerns over various aspects of the program. Significant reforms announced in June 2014 have also had an impact on them. In February 2016, in response to feedback from various stakeholders with respect to the TFW Program, the Minister of Employment, Workforce Development and Labour indicated that a comprehensive review of the program was imminent and that a study by a parliamentary committee could offer support in this regard. On 21 March 2016, the House of Commons Standing Committee on Human Resources, Skills and Social Development and the Status of Persons with Disabilities (the Committee) adopted a motion to study the TFW Program, with a “focus on the current program and ways to improve it.” The Committee held a total of five meetings between 11 May and 1 June 2016, during which time it heard from 47 witnesses, including representatives from two federal government departments, labour organizations, advocacy groups, industry associations, business representatives, as well as temporary foreign workers. In addition to these public hearings, the Committee received a total of 63 briefs”--p. 1.

If you believed most of what’s said about the Canadian Temporary Foreign Worker program, you might naturally assume that there is a trade-off between workers’ poor experiences with the program and employers’ significant benefits. In reality, the experiences of workers are far worse than is commonly acknowledged, while employers are not reaping as much benefit as the public might suppose. From its inception in 1966, the Canadian Seasonal Agricultural Worker Program (SAWP) has grown to employ approximately 20,000 workers annually, the majority from Mexico. The program has been hailed as a model that alleviates human rights concerns because, under contract, SAWP workers travel legally, receive health benefits, contribute to pensions, are represented by Canadian consular officials, and rate the program favorably. Tomorrow We're All Going to the Harvest takes us behind the ideology and examines the daily lives of SAWP workers from Tlaxcala, Mexico (one of the leading sending states), observing the great personal and family price paid in order to experience a temporary rise in a standard of living. The book also observes the disparities of a gutted Mexican countryside versus the flourishing agriculture in Canada, where farm labor demand remains high. Drawn from extensive surveys and nearly two hundred interviews, ethnographic work in Ontario (destination of over 77 percent of migrants in the author's sample), and quantitative data, this is much more than a case study; it situates the Tlaxcala-Canada exchange within the broader issues of migration, economics, and cultural currents. Among the many challenges that global liberalization has posed for trade unions, the growth of precarious immigrant workforces lacking any collective representation stands out as both a major threat to solidarity and an organizing opportunity. Believing that collective action is critical in the struggle to lift the low wages and working conditions of immigrant workers, the contributors to Mobilizing against Inequality set out to study union strategies toward immigrant workers in four countries: Germany, France, the United Kingdom, and United States. Their research revealed both formidable challenges and inspiring examples of immigrant mobilization that often took shape as innovative social countermovements. Using case studies from a carwash organizing campaign in the United States, a sans papiers movement in France, Justice for Cleaners in the United Kingdom, and integration approaches by the Metalworkers Union in Germany, among others, the authors look at the strategies of unions toward immigrants from a comparative perspective. This publication offers an overview of the Temporary Foreign Worker Program in Canada and provides a summary of the benefits and concerns surrounding temporary migration. A "temporary foreign worker" or "migrant worker" is a foreign national engaged in paid work activity who is authorized, with the appropriate documentation, to enter and to remain in Canada for a limited period. A "work permit" allows a foreign national to engage in employment in Canada, and a "visa" allows a foreign national to enter Canada. Depending on the nature of the activity in Canada and the country of origin of the foreign worker, a work permit and/or visa may not be necessary. This paper will focus on authorized temporary foreign workers at a national level and does not describe provincial programs for temporary foreign workers.
