El artículo 12 del Texto Único Ordenado del Decreto Legislativo N°728, Ley de Productividad y Competitividad Laboral, aprobado por el Decreto Supremo N°003-97-TR, regula los supuestos de suspensión del contrato de trabajo o suspensión de labores, entre los que se encuentra aquel originado por caso fortuito y fuerza mayor. A fin de poder de contextualizar el uso de este último, el primer capítulo del libro presenta un análisis teórico de la institución de la suspensión de labores, a partir de las características identificadas por la doctrina y su fundamento en el derecho al trabajo. Luego de ello, el segundo capítulo describe de manera general la suspensión de labores por caso fortuito o fuerza mayor, y detalla los hallazgos del análisis realizado a resoluciones directorales generales emitidas por la Dirección General de Trabajo del Ministerio de Trabajo y Promoción del Empleo en el período comprendido entre el 2013 y 2019, en los aspectos referidos a la causa objetiva, el otorgamiento de vacaciones vencidas, adelantadas y de otras medidas alternativas. También, se realiza una revisión a la legislación comparada para identificar las diferencias con la regulación peruana de dicha institución. El último capítulo presenta al lector una propuesta de modificación de la suspensión perfecta por caso fortuito y fuerza mayor en aspectos referidos a la delimitación del caso fortuito y la fuerza mayor, el uso de las medidas alternativas, la duración de la suspensión y algunos aspectos del procedimiento administrativo.

After Francisco Franco's victory in the Spanish Civil War, a great many of the country's intellectuals went into exile in Mexico. During the three and a half decades of Francoist dictatorship, these exiles held that the Republic, not Francoism, represented the authentic culture of Spain. In this environment, as Sebastiaan Faber argues in Exile and Cultural Hegemony, the Spaniards' conception of their role as intellectuals changed markedly over time. The first study of its kind to place the exiles' ideological evolution in a broad historical context, Exile and Cultural Hegemony takes into account developments in both Spanish and Mexican politics from the early 1930s through the 1970s. Faber pays particular attention to the intellectuals' persistent nationalism and misplaced illusions of pan-Hispanist grandeur, which included awkward and ironic overlaps with the rhetoric employed by their enemies on the Francoist right.
