Pursuant to a congressional request, GAO reviewed natural resource damage provisions of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), focusing on: (1) the prospect for future claims by the federal government against polluters for natural resources damage; (2) the amount and use of settlements that federal agencies have already collected from polluters; and (3) the guidelines used by federal agencies to determine an appropriate amount of compensation for natural resources damage. GAO found that: (1) the Department of the Interior and the National Oceanic and Atmospheric Administration estimate that 60 sites may eventually have claims for damages to natural resources that will equal or exceed $5 million and that up to 20 of these sites may have claims exceeding $50 million; (2) of the $83.8 million owed to the federal government for the five largest natural resource damage settlements, only about 40 percent has been collected, and 11 percent of these funds has been spent; (3) the collected money has been used to reimburse trustees for completed damage assessments and to pay for natural resource restoration plans; (4) while CERCLA did not require standards or methods to determine damages, it directed Interior to develop consistent procedures that trustees should consider when assessing damages to natural resources; (5) trustees rarely use either of the procedures, since one is limited in scope and the other is costly and time-consuming; and (6) the 95 settlements reached as of April 1995 used abbreviated procedures that use readily available site-specific information and scientific literature to quantify damages.

Pursuant to a congressional request, GAO reviewed the status of the settlements reached in the five largest federal natural resource damage cases, focusing on the: (1) number and status of the remaining settlements under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980; and (2) uses made of the collected funds. GAO found that: (1) as of July 1, 1996, in addition to the settlements for the 5 largest cases, settlements had been reached at 62 sites, resulting in $33.8 million in awards to federal trustees; (2) about 80 percent of the $33.8 million awarded had been collected; (3) about 19 percent of the collected funds had been allocated for performing damage assessments, planning, or restoration; (4) one site had been restored, and seven were in various stages of restoration; and (5) the trustees' use of the remaining 81 percent of the collected funds was awaiting the completion of restoration plans or other activities, such as cleanups or settlements with other responsible parties at the same site.

GAO noted that: (1) as of April 1995, federal agencies had settled 98 natural resource damage claims for an estimated total of $106 million, with most cases requiring no payments or payments of less than $200,000; (2) the value of these settlements is small compared to Superfund cleanup agreements, but some outstanding claims involve hundreds of millions of dollars; (3) 4 of the 9 states contacted had independently settled 17 CERCLA claims for $129.4 million; (4) state CERCLA actions vary considerably; (5) although federal and state officials cannot predict the number or value of future damage claim settlements, they have identified 3 damage settlements that could exceed $500 million; and (6) an uncertain number of federal facilities may be subject to large damage claims which could severely impact the federal budget.
