Excerpt from Statutes and Ordinances and Acts of the-Parliament of Ireland, Vol. 1 The earliest printed edition of the Statutes of Ireland is that of Sir Henry Sydney, which was published in London, by R. Totell, 1572, with the following title: - "In this volume are contained all the Statutes from the tenthe yere of King Henrie the Sixt, to the xiiii. yere of our most gracious and soueraygne lady Queene Elysabeth; made and established in her Highness' Realme of Ireland." Anthony & Wood, in his Athen. Oxon. (Vol. I., col. 513), notices the volume, stating that he had seen Sir Henry Sydney's Miscellanies of Irish A flairs; "who had also caused the Statutes of Ireland to be first published in print." Sir Henry, who acted as Lord Justice or Lord Deputy of Ireland on four occasions during the period 1558-1578, published his work on the conclusion of his third Viceroyalty, and states in his Preface that he had caused the Justices of both Benches, the Chief Baron of the Exchequer, and the Master of the Rolls of Ireland, to confer together for the copying out and examining such Statutes as were then of record and not published; which they did, and delivered the same perfectly written and examined. As this edition only commenced at the period when Vol. II. of the present edition will begin, no further notice of it is necessary here. Or, to use the words of Molyneux in his celebrated pamphlet of the P Case of Ireland Stated, there was an entire and voluntary Submission of all the ecclesiastical and civil states of Ireland to King Henry IL, without the least hostile strike on any Side; we hear not in any of the chronicles of any violence on either part all was transacted with the greatest quiet, tran quillity, and freedom imaginable. England may be said much more properly to have been conquered by Wila liam I. Than Ireland by Henry II. Henry received not the least opposition in Ireland; all came in peaceably, and had large concessions made them of the like laws and liberties with the people of England, which they gladly accepted. Upon the former of these subjects it is not to be antici pated that we should find in any work, composed by a lawyer of the Brehon school, a series of definite rules systematically arranged; or even an attempt to lay down the general principles upon which, in any class of cases, the judge or arbitrator proceeded. The idea of law in its technical sense was wholly foreign to the ancient lawyers. They dealt not with laws, but customs; which, of unknown origin, handed down from remote antiquity, often obscure, and frequently misconceived, influenced the public Opinion of each tribal community as to what it was right should be done in each particular case. The Brehons were gradually approaching the idea of general legal propositions by an induction from numerous and distinct cases which had been decided in accordance with pre-existing customs.
