Excerpt: ...fact which is perfectly applicable to the matter in question. can or the In 1852, for reasons which it would be out of Ajggiigggd place to recall here, the Government of the Perm United States of America disputed the right of Peru over the Lobos Islands, arguing that they were not included in the Peruvian Constitution, which, as in the case of Chile, enumerated the territories belonging to the Republic. Respecting this there ensued a diplomatic discussion between the Governments of Lima and Washington, which ended in an acknowledgment by the latter of the principles for which we contend. In a despatch addressed to the Charge d'Affaires of the United States at Lima, under date of the 23rd of October of the said year, 1852, the Peruvian Minister for Foreign Affairs laid down this principle in the following terms: "The fact that a part of the territory be not mentioned in the Constitutional Law of a State, which is only a political law, will not be considered by the Charge d'Affaires as a sufficient reason for repudiating its territorial rights, based on a title derived from the law of nations. lf this assertion be correct, Peru cannot consider that her ight of ownership respecting the Lobos Islands is in any degree less than that which she possesses in the rest of the places forming her territory, whether they have or not been circumstantially and deliberately determined in her political constitutions." ' The Government of Vl/ashington, having been informed of the circumstances of this case, categorically declared that the Government of Peru was entirely in the right and withdrew their claim.
