Major land reform programs have reallocated property in more than one-third of the world's countries in the last century and impacted over one billion people. But only rarely have these programs granted beneficiaries complete property rights. Why is this the case, and what are the consequences? This book draws on wide-ranging original data and charts new conceptual terrain to reveal the political origins of the property rights gap. It shows that land reform programs are most often implemented by authoritarian governments who deliberately withhold property rights from beneficiaries. In so doing, governments generate coercive leverage over rural populations and exert social control. This is politically advantageous to ruling governments but it has negative development consequences: it slows economic growth, productivity, and urbanization and it exacerbates inequality. The book also examines the conditions under which subsequent governments close property rights gaps, usually as a result of democratization or foreign pressure.

During the past two decades, there has been a resurgence of interest in issues of land reform in developing and transitional countries. This has been initiated by the large-scale re-distributive activities in former communist countries and by the growing number of claims by displaced indigenous population groups to restore their rights to land. This book provides a timely and clear overview of the historical and theoretical context of current land reform and tenure issues. Illustrated with global case studies from Europe, Asia, Africa and Latin America, key sections explore land and rights to land, property, land tenure and reform, and land registration. Beginning by discussing the need to demarcate space by creating 'invisible lines' - which give certainty to what extent authority over land can be established - the book then explores legal and theoretical definitions of 'land' and 'property' and looks at the various different policies and forms of land tenure. One of the most recent developments in land reform policy has been to look to traditional forms of access to land and of resource conservation. The book argues that, while such policies on land property rights have great potential, they are best being adopted in a long-term, incremental way. It also shows how land policy reforms must be embedded in institutional and general policy reforms, complemented by rural development and educational opportunities for beneficiaries. The book summarises the main principles of land reform activities and practices and argues that the perception of land tenure security is the most critical factor of success to land reform.

This book is the first systematic attempt to address emerging land markets and their implications for poverty, equity, and efficiency across a number of African countries. The high incidence of poverty and the need for increased agricultural productivity remain acute in rural areas of sub-Saharan Africa, where a lack of secure land rights and a growing scarcity of land relative to the size of the population are becoming increasingly critical issues. Indeed, land issues in the region are high on the international policy agenda. Yet our knowledge about land tenure security and other rural factor markets (such as labor, oxen, manure, purchased inputs, and credit) is far from adequate to formulate sensible policies. The case studies in the book show that, while land markets and especially informal markets have been rapidly emerging in densely populated parts of Africa - and have generally been to the benefit of the poor--their functions remain imperfect. This is due to policy-induced tenure insecurity and the fragmentation of agricultural land. Applying rigorous quantitative analyses, the book provides a basis for taking into account the role of land markets in national land policies. All too often, the authors argue, land policies have been extreme, either prohibiting all land transactions or giving unrestricted freehold rights to a small elite at the expense of the poor. From the long experience in Asia, it is known that such policies are detrimental to both production efficiency and equity of land use. The authors argue that future policies in Africa should work with the markets. Regulations should be imposed only with careful testing that they are having the intended effects. The Emergence of Land Markets in Africa is a resource for teaching in developed and developing countries, as it provides both comprehensive reviews of the literature and detailed case studies. It is intended to facilitate the dialogue between researchers and policymakers, as well as inspire researchers to go further in their investigations and build an even stronger basis for good policies.
