Since the very onset of the European Union, the founding fathers and policy-makers have tasked themselves with the goal of free movement within the single market and ideally within united and borderless Europe. The two seemingly separate and independent developments allowed for the realization of these early aspirations for unhindered circulation within the territory of the larger EU; the gradual and step-by-step abolition of barriers to trade and movement in the name of economic integration as orchestrated by the Community on one hand, and the intergovernmental agreement binding a handful of states outside of the EU legal framework on the other. Intimately intertwined with the Single European Market, the latter-although originating from without of the European Community legislation- has significantly contributed to shifting from purely economic freedoms of workers to encompass also further non-economic rights of the remaining public. The incorporation into the EU legal framework and its current status can only hardly be explained without taking into account Schengen in tandem with the SEA.The aim of this paper is to examine the implications of inclusion with the Amsterdam Treaty of the Schengen Agreement into the web of European legislation, as well as to disentangle the very process of this incorporation.

This volume offers an evaluation of the Schengen Information System and border control co-operation from a transparency and proportionality perspective. It also incorporates a legal descriptive analysis of the co-operation in order to accommodate the changes and developments that occurred during the writing period. The transparency and proportionality perspectives are developed from human rights and data protection criteria. Transparency is understood as knowledge and accessibility to legal information as well as openness and accountability. On the other hand, proportionality is a requirement for guidance, balance and justification as well as a need to avoid excessiveness and arbitrariness in border control work. The final findings reveal that the Schengen co-operation suffers from a deficiency of transparency and proportionality. Consequently, measures are proposed to augment the deficiency. Even as this study was reaching its conclusion, fundamental legislative changes, closely similar to some of the arguments and recommendations projected in this study, took place. The efficacy of these changes is yet to be discerned.

Signed in 1985 by France, Germany, Belgium, Luxembourg, and the Netherlands, the Schengen Agreement had a significant impact on the integration of the European Community/European Union, particularly by providing for the gradual abolishment of border controls to facilitate the free movement of persons within the "Schengenland," i.e. the area of the states participating in the Schengen Agreement. Initially an intergovernmental agreement, later it was incorporated into the E.U.'s framework under the Amsterdam Treaty. Now the Schengen acquis, consisting of the set of rules of all the agreements, conventions, accession protocols, decisions and declarations accepted by the Schengen bodies, has become an integral part of 15 countries, two of which are non-E.U. states. Borders define territories within which identities and order are described and delineated. The triptych of indentities, borders and orders is central to understanding the nature of sovereignty and the relations between countries. Nowhere is this more apparent than in the European Union. The changing definition and placement of the border is one of the most striking features of the recent transformations of the Union. The definition of what a border is and where it is for persons has moved out of the territory of national sovereignty and has become the preserve in law of the European Community. The enlargement of the European Union towards the countries of Central and Eastern Europe has created new challenges for the concept of borders in the EU. This volume examines the extent of the Community power and the legal meaning of the EU's borders, as well as the ways to control (or not) the movement of persons across borders.
