This book maps the problems and possibilities of the policies and practices designed to tackle violence against women in the domestic sphere over the last 40 years. In 2018, the United Nations declared the home the most dangerous place for women around the word, and in early April 2020, the United Nations Population Fund predicted that for every three months that government-enforced lockdowns in response to coronavirus an additional 15 million cases of domestic violence would occur worldwide. This book explains why the earliest cities had grid-form street systems, what conditions led to their being overwhelmingly preferred for 5000 years throughout the world, why the Founding Fathers wanted gridform cities and how they affect economic transactions. Real property has been instrumental in forming urban settlements for 5000 years, but virtually all urban form commentary, theory and research has ignored this reality. The result is an incomplete and flawed understanding of cities. Real property became a means of arranging spatial patterns caused by millennia of human evolutionary and historical developments with respect to access and movement. As a result, access to resources of all types became a regulatory mechanism controlled, at least in part, by real property ownership. The effects of real property on urban spatial patterns are currently best seen by examining American urban space, which has changed significantly over the past 200 years. This book examines the justice gap and trial process for sexual assault against both adults and children in two jurisdictions: England and Wales and New South Wales, Australia. Drawing on decades of research, it investigates the reality of the policing and prosecution of sexual assault offences – often seen as one of the ‘hardest crimes to prosecute’ – across two similar jurisdictions. Despite the introduction of the many reform options detailed in the book, satisfactory outcomes for victims and the public are still difficult to obtain. Cossins takes a new approach by examining the nature and effects of adversarialism on vulnerable witnesses, jury decision-making and the structures of power within the trial process, to show how, and at what points, that process is weighted against complainants of sexual assault, in order to make evidence-based suggestions for reform. She argues that this justice gap is a result of a moralistic adversarial culture which fosters myths and misconceptions about rape and child sexual assault, thus requiring the prosecution to prove a complainant’s moral worthiness. She argues this culture can only be eliminated by a radical replacement of the adversarial system with a trauma-informed system. By reviewing the relevant psychological literature, this book documents the triggers for re-traumatisation within an adversarial trial, and discusses the reform measures that would be necessary to transform the sexual assault trial from one where the complainant’s moral worthiness is ‘on trial’ to a fully functioning trauma-informed system. Through theoretical and empirical examination of legal frameworks for court diversion, this book interrogates law’s complicity in the debilitation of disabled people. In a post-deinstitutionalisation era, diverting disabled people from criminal justice systems and into mental health and disability services is considered therapeutic, humane and socially just. Yet, by drawing on Foucauldian theory of biopolitics, critical legal and political theory and critical disability theory, Steele argues that court diversion continues disability oppression. It can facilitate criminalisation, control and punishment of disabled people who are not sentenced and might not even be convicted of any criminal offences. On a broader level, court diversion contributes to the longstanding phenomenon of disability-specific coercive intervention, legitimates prison incarceration and shores up the boundaries of foundational legal concepts at the core of jurisdiction, legal personhood and sovereignty. Steele shows that the United Nations Convention on the Rights of Persons with Disabilities cannot respond to the complexities of court diversion, suggesting the CRPD is of limited use in contesting carceral control and legal and settler colonial violence.
