International Law and the Arctic

International Law and the Arctic PDF Author: Michael Byers
Publisher: Cambridge University Press
ISBN: 1107435951
Category : Law
Languages : en
Pages : 341

Book Description
Climate change and rising oil prices have thrust the Arctic to the top of the foreign policy agenda and raised difficult issues of sovereignty, security and environmental protection. Improved access for shipping and resource development is leading to new international rules on safety, pollution prevention and emergency response. Around the Arctic, maritime boundary disputes are being negotiated and resolved, and new international institutions, such as the Arctic Council, are mediating deep-rooted tensions between Russia and NATO and between nation states and indigenous peoples. International Law and the Arctic explains these developments and reveals a strong trend towards international cooperation and law-making. It thus contradicts the widespread misconception that the Arctic is an unregulated zone of potential conflict.

International Law for Seagoing Officers, 7th Edition

International Law for Seagoing Officers, 7th Edition PDF Author: Craig H Allen
Publisher: Naval Institute Press
ISBN: 1682478610
Category : Law
Languages : en
Pages : 572

Book Description
The seventh edition of this Blue and Gold Series book brings clarity and context to international law for the seagoing professional. This book is the only work that addresses the international law of the sea from the perspective of the United States. For those who operate on, under and over the sea, international law can sometimes be as complex as it is important. Written by the same former seagoing officer and maritime law professional who authored the current edition of Farwell’s Rules of the Nautical Road, this book was designed to bring clarity and context to international law for the seagoing professional. Following an introduction to public international law and a short history of the law of the sea, the book describes the rules that apply in ports and in the adjacent maritime zones, including the territorial sea, exclusive economic zone, archipelagic waters, and the high seas. A highlight of the book are the chapters that focus on subjects of greatest interest to the seagoing professional, including military and intelligence activities in the maritime domain, maritime law enforcement activities and the use of force at sea. The appendices include the text of the 1982 UN Convention on the Law of the Sea and the U.S. Senate’s “understandings” of key provisions of the convention. Whether an academy cadet, a midshipman, a seasoned commanding officer, or master mariner, readers of this thorough and timely book will be rewarded with a far greater understanding of the international laws that govern ships and mariners at sea. New in this edition: Over a dozen new cases by courts and arbitration panels interpreting UNCLOS, including the South China Sea dispute between the Philippines and China. Coverage of Commercial Seafarer protections under Maritime Labor Convention. Global Responses to the Mediterranean Migrant Crisis. Coverage of the law protecting our vital submarine cables. Expanded coverage of unmanned and autonomous vessels and aircraft. Coverage on vessel health safety and quarantine measures applicable in the COVID-19 Pandemic. A new chapter surveying issues the U.S. Senate should consider in any decision regarding ratification of UNCLOS. A new appendix setting out the U.S. Navy and Coast Guard policies on sovereign immunity of government vessels and aircraft.

Structural Integrity of Offshore Wind Turbines

Structural Integrity of Offshore Wind Turbines PDF Author: Transportation Research Board
Publisher: National Academies Press
ISBN: 0309225159
Category : Science
Languages : en
Pages : 109

Book Description
TRB Special Report 305: Structural Integrity of Offshore Wind Turbines: Oversight of Design, Fabrication, and Installation explores the U.S. Department of the Interior's Bureau of Ocean Energy Management, Regulation, and Enforcement (BOEMRE) approach to overseeing the development and safe operation of wind turbines on the outer continental shelf, with a focus on structural safety. The committee that developed the report recommended that in order to facilitate the orderly development of offshore wind energy and support the stable economic development of this nascent industry, the United States needs a set of clear requirements that can accommodate future design development. The report recommends that BOEMRE develop a set of requirements that establish goals and objectives with regard to structural integrity, environmental performance, and energy generation. The committee found that the risks to human life and the environment associated with offshore wind farms are substantially lower than for other industries such as offshore oil and gas, because offshore wind farms are primarily unmanned and contain minimal quantities of hazardous substances. This finding implies that an approach with significantly less regulatory oversight may be taken for offshore wind farms. Under this approach, industry would be responsible for proposing sets of standards, guidelines, and recommended practices that meet the performance requirements established by BOEMRE. The domestic industry can build on standards, guidelines, and practices developed in Europe, where the offshore wind energy is further developed, but will have to fill gaps such as the need to address wave and wind loadings encountered in hurricanes. The report also includes findings and recommendations about the role that certified verification agents (third party evaluators) can play in reviewing packages of standards and project-specific proposals.

Challenges of the Changing Arctic

Challenges of the Changing Arctic PDF Author: Myron H. Nordquist
Publisher: BRILL
ISBN: 9004314253
Category : Law
Languages : en
Pages : 646

Book Description
The law and policy for the Arctic are increasingly of international interest, largely due to the melting of the Arctic ice cap. Challenges of the Changing Arctic: Continental Shelf, Navigation, and Fisheries includes contributions from global specialists dealing with the geomorphologic context, maritime delimitation and specialized topics raised by promising oil and gas prospects, particularly in the extensive continental shelf presented by Russia to the Commission on the Limits of the Continental Shelf. Arctic shipping has entered a novel, untested phase with keen interest in the opening of ice free shipping lanes and proposed regulatory regimes. Fish in the North Atlantic are moving north disrupting historic fishing patterns as well as traditional fish stocks. Agreements on the allocation of shared fish stocks pose significant management challenges. Both littoral and non-littoral user nations are concerned with maritime security as well as search and rescue preparations given the anticipated increased use of the Arctic Ocean. These and many other of the most pressing issues are addressed in this important volume, making it a must-read for all those interested in environmental law and the law of the sea.
