In the fall of 1988, a series of events relating to the enforcement of the Occupational Health and Safety Act raised public interest and concern. The labour movement expressed concern over the blatant defiance of Stop Work Orders; a failure to prosecute offenders under the Act; and interference with or delay in the enforcement procedure at the Saint John Foundry. The Occupation Health and Safety Commission was asked to review the issues raised at the St. John Foundry and to identify deficiencies in policies or procedures which hamper enforcement of the Act, and to recommend amendments to the Act or its regulations which would facilitate its enforcement. This report covers the measures taken at the Foundry, as well as the results of the internal review on enforcement, including deadlines, delivery/posting, follow-up, design of report form, chain of command, commission staffing levels, occupational diseases, and appeal procedures.
