Despite being a common driver of communal violence, blood revenge has received little attention from scholars. With many civil wars and insurgencies occurring in areas where the custom lingers, strengthening our understanding of blood revenge is essential for discerning how conflicts change and evolve. Drawing upon extensive multidisciplinary evidence, this book is the first in the literature on civil war and insurgency to analyse the impact of blood revenge and its modern remnants on irregular warfare. This volume examines the causes and purposes of 'post-conflict' violence. The end of a war is generally expected to be followed by an end to collective violence, as the term ‘post-conflict’ that came into general usage in the 1990s signifies. In reality, however, various forms of deadly violence continue, and sometimes even increase after the big guns have been silenced and a peace agreement signed. Explanations for this and other kinds of violence fall roughly into two broad categories – those that stress the legacies of the war and those that focus on the conditions of the peace. There are significant gaps in the literature, most importantly arising from the common premise that there is one, predominant type of post-war situation. This ‘post-war state’ is often endowed with certain generic features that predispose it towards violence, such as a weak state, criminal elements generated by the war-time economy, demobilized but not demilitarized or reintegrated ex-combatants, impunity and rapid liberalization. The premise of this volume differs. It argues that features which constrain or encourage violence stack up in ways to create distinct and different types of post-war environments. Critical factors that shape the post-war environment in this respect lie in the war-to-peace transition itself, above all the outcome of the war in terms of military and political power and its relationship to social hierarchies of power, normative understandings of the post-war order, and the international context. Developing a better understanding of the dynamics of violence in post-war states can lead to a more durable peace. The end of one war is frequently the beginning of another because the cessation of conflict produces two new challenges: a contest between the winners and losers over the terms of peace, and a battle within the winning party over the spoils of war. As the victors and the vanquished struggle to establish a new political order, incidents of low-level violence frequently occur and can escalate into an unstable peace or renewed conflict. Michael J. Boyle evaluates the dynamics of post-conflict violence and their consequences in Violence after War. In this systematic comparative study, Boyle analyzes a cross-national dataset of violent acts from 52 post-conflict states and examines, in depth, violence patterns from five recent post-conflict states: Bosnia, Rwanda, Kosovo, East Timor, and Iraq. In each of the case studies, Boyle traces multiple pathways through which violence emerges in post-conflict states and highlights how the fragmentation of combatants, especially rebel groups, produces unexpected and sometimes surprising shifts in the nature, type, and targets of attack. His case studies are based on unpublished data on violent crime, including some from fieldwork in Kosovo, East Timor, and Bosnia, and a thorough review of narrative and witness accounts of the attacks. This volume offers a new theoretical approach to the analysis of the law/revenge binary, and attempts to dismantle the common idea of revenge as lacking any legal, moral or rational dimension. In contrast, the book puts forward a model of a complex system of justice—which it terms 'vindicatory'—wherein vendetta constitutes an authorized action, the core of which does not (just) lie in vengeance but also in settlement procedures for peace—or 'composition.' The first part of the book ("Vindicatory Justice: Conceptual Analyses and Forerunners") seeks to identify the nature of vindicatory justice and to shed light on the structure of so-called vindicatory systems. In turn, the second part ("Mapping Vindicatory Justice") illustrates, using examples gathered from a range of sociolegal contexts, the dynamic relationship between composition and authorized revenge in vindicatory systems. Taken as a whole, the volume shows that applying a longue durée historical perspective to the study of revenge systems allows us to clearly recognize composition and authorized revenge as features of the same legal system, even though one of them may seem predominant (or more eye-catching) than the other in certain cultural settings.
