El libro también brinda una crítica de las formas jurídicas que toma el pensamiento neoliberal. A la luz de estos dos objetivos, no parece haber una mejor audiencia para este libro que la latinoamericana. Es en las latitudes meridionales donde el derecho de las inversiones ha tenido su más profundo impacto y donde continúa moldeando (y limitando) la capacidad estatal de implementar políticas públicas. Poner a prueba estas limitaciones frente a los postulados de los más importantes teóricos sociales ayuda, creo, a agudizar nuestro entendimiento de este régimen. Uno solo puede concluir que el régimen no es mucho más que el puro uso de la fuerza del derecho para maniatar a los estados y a los ciudadanos del Sur global.
