All regulations are costly and reduce personal freedoms. Some of them bring benefits in excess of these costs, but in recent decades many new regulations have been designed to produce benefits that are ephemeral and highly uncertain so that their value cannot be measured objectively for use in cost/benefit calculations. While legislators in principle are able to evaluate these ephemeral and uncertain benefits in the light of mandates from their constituencies, in practice they are evaluated by civil servants in regulatory agencies, many of which have been attracted to employment by these agencies because it offers them the opportunity to contribute to what they consider to be the creation of an ideologically better world in which market outcomes are modified by regulations. Efforts by the Trump administration and Republican Congress to reform the regulatory system faces very serious challenges to prevent these civil servants from continuing to have their estimates of the benefits influenced by their ideological preferences and thus bias the nature of future regulations.

This book analyses the egalitarian foundations of equality law from a classical liberal perspective by asking two central questions: does justice ideally demand equality? Are differences in abilities among people in some sense unfair? The book examines these questions in the context of racial diversity. Racial justice as a component of social justice is often considered to be so emotionally and morally compelling that its implications for economic freedom are rarely subjected to critical scrutiny. In defending the classical ideal of formal equality in contexts of racial diversity this book questions the ethical status of egalitarian social and moral ideals. Economic Freedom and Social Justice argues that egalitarian ideals, like all subjective value judgements, must be subjected to critical intellectual inquiry rather than treated axiomatically. The Covid-19 pandemic led to extensive new government regulations and lockdown policies that significantly reduced economic freedom across U.S. states. Many of these new pandemic-related regulatory restrictions on economic freedom varied significantly from state to state but are largely missed by the existing Economic Freedom of North America Report (EFNA). This paper adjusts the Our World in Data Covid-19 Stringency Index into a state-level measure of lockdown regulatory freedom and then merges it into the EFNA index to better measure relative economic freedom across U.S. states in 2020. We find significant differences in the relative ranking of economic freedom between states once we adjust for lockdown regulatory restrictions.
