This book describes the global legal framework for safeguarding the “Intangible Cultural Heritage” – as defined by the UNESCO Convention in 2003 – and analyses its use in selected countries in the Americas, Asia, Africa and Europe. Each of the contributions has been prepared by high profile experts and strategically addresses countries that are representative for their corresponding area. Our understanding of the term “Cultural Heritage” has changed considerably over the past few decades, and it is becoming increasingly clear that the concept also includes traditions and living expressions that we inherit from our ancestors and pass on to our descendants. UNESCO has recognised and responded to this change of perspective, creating through the 2003 Convention an international instrument for safeguarding the “Intangible Cultural Heritage”, a notion including oral traditions, performing arts, social practices, rituals, festive events, knowledge and practices concerning nature and the universe, as well as the knowledge and skills needed to produce traditional crafts. New values, practices and heritages were recognized – from the ancient African rituals to the Mexican Mariachi musical expression to the Brazilian Samba and the Mediterranean Diet – all of which convey strong social and cultural meaning for their community's identity. Intangible Cultural Heritage is a growing, relatively recent field of study and also an emblem of the dialogue between distant populations with different cultures, which is the reason why a comparative approach is the most appropriate basis for conducting an analysis of how the contracting states to the Convention live up to their commitments through national safeguarding measures and enhancement policies or through international cooperation projects.

This Open Access book explores heritage conservation ethics of post conflict and provides an important historical record of the possible reconstruction of the Bamiyan Buddha statues, which was inscribed in the UNESCO World Heritage List in Danger in 2003 as “Cultural Landscape and Archaeological Remains of the Bamiyan Valley”. With the condition that most surface of the original fragments of the Buddha statues were lost due to acts of deliberate destruction, this publication explores a reference point for conservation practitioners and policy makers around the world as they consider how to respond to on-going acts of destruction of cultural heritage. Whilst there has been an emerging debate to the ethics and nature of heritage reconstruction, this volume provides a plethora of ideas and approaches concerning the future treatment of the Bamiyan Buddha statues. It also addresses a number of fundamental questions on potential heritage reconstruction: how it will be done; who will decide; and what it should be done for. Moreover when it comes to the inscribed World Heritage properties, how can reconstructed heritage using non-original materials be considered to retain authenticity? The volume attempts to triangulate three vibrant discourses of our times: It combines postcolonial and decolonial readings of cultural conflicts with assessments of ecological dimensions of those conflicts, as well as their significance within discourses on natural and cultural world heritage. The examples from four continents range from the medieval Middle East - already shaken by a convergence of ecological and social disaster - to modern imaginary constructions of medieval Vikings, the persistence of Indigenous knowledge in the Arctic, literary poetics of patrimony, and the heritage politics of Mediterranean urban architecture. Authors ask which strategies societies in developing countries use to defend their cultural and ecological uniqueness and integrity while being penetrated by environmental hazards and hegemonizing 'Western' forms of heritage culture; or how western societies construct their own past in ways that are sometimes reminiscent of traditional imaginations of a pre-modern past, petrified eternally in an 'ideal' moment of time. Colonial and historical forms of 'heritagization' of human and non-human environments, the essays show, answer to pressing emotional needs for a sense of stability. But the desire for nostalgia, frequently commodified, tends to collide with the similarly pressing need for political and economic survival in a rapidly changing world and in the face of accelerating extraction practices. Without being able to solve this dilemma, the volume makes an interdisciplinary contribution to taking intellectual stake of the asymmetrical politics and poetics of heritage and collective cultural memory.
