Tras su primera obra, sobre Crisis familiares y animales domésticos, en esta segunda se adentra en otra cuestión también polémica y muy litigiosa en el foro: la tenencia de animales domésticos en pisos o casas en régimen de comunidad (se trate de edificios o de urbanizaciones privadas). Aborda cuestiones tales como la posible defensa de la comunidad de vecinos ante actividades molestas, insalubres, peligrosas o dañinas causadas por animales, tanto en pisos, locales y chalés, como en las zonas comunes del complejo inmobiliario; o si cabe la posibilidad de que, de forma preventiva, la comunidad de propietarios prohíba, limite o condicione de algún modo la presencia misma de animales en la vivienda o en todo el edificio a fin de garantizar una convivencia pacífica; … Ante la falta de una norma particular que resuelva estas y otras cuestiones (como la tenencia de animales en alquileres y hospedajes), en la presente obra se hace exposición detallada y exhaustiva de su solución “oficial”, auspiciada por nuestros tribunales, aunque también se propone en la obra una posible solución alternativa, más acorde al Derecho de otros países, al “nuevo” principio de protección del bienestar animal, en cuanto ser vivo dotado de sensibilidad, y a la relación afectiva humano-animal, que merece ser también jurídicamente protegida, según se concibe hoy la convivencia en compañía de animales en la nueva realidad social y jurídica, europea y española. Una propuesta de solución alternativa que, aunque fundada en el Derecho vigente, también se expone a modo de reforma legislativa, muy oportuna ahora en que nuestro Parlamento está inmerso en la tramitación de una gran reforma legislativa sobre animales en la que, sin embargo, parece obviarse el problema que en esta obra se trata, y que aquí se formula a modo de enmienda (con un texto legal adecuado).

Against the background of the creation of an EU-wide frame of reference for private law relevant to the Common Market, this study, which was requested by the EU Commission, analyses the dovetailing between contract and tort law on the one hand, and between contract and property law on the other. The study examines the legal orders of almost all the Member States of the EU, illustrates the differences between contractual and non-contractual liability and evaluates the different systems of the transfer of property, of movable and immovable securities as well as trust law. The study comes to the conclusion that the intensive considerations on the creation of a model-law in the area of European private law do not allow these thoughts to be limited to contract law. Such a limitation to the scope of the regarding of this area would probably cause more problems than it would solve, or at any rate not do justice to the needs of the Common Market.
