Book Description
The series consists of court dockets kept by the court clerk. Court dockets are court calendars which record all cases in order for each court term, assigning a number to each case. Before 1895 Franklin County courts followed an unusual docketing system in which cases were arranged in order of their beginning court term, and kept the same docket number for all court terms. For any given court term, there might be several cases with the same docket number. After 1895, each case retains a unique original number through all court terms. Dockets for the period 1914 to 1943 consist of loose-leaf sheets arranged chronologically, with one sheet recording all information on each case, rather than calendars docketing all cases for each court term. Two card indexes, arranged alphabetically, contain brief entries on supreme court cases from 1897-1935, and 1933-1961. Card entries include references to published Vermont supreme court reports. Docket entries include plaintiff and defendant, attorneys, and a brief summary of action taking place that court term. Entries often include court costs for a case, and may include the criminal charge or type of civil case. Dockets usually record the names of judges and clerk and note court term dates. Early dockets include bar admissions and court accounts. All but the first volume are indexed alphabetically by plaintiff. Chancery cases are intermingled with regular supreme court cases in 1800-1807 dockets, but are identified as chancery in docket entries. Chancery cases are docketed and entered separately after 1808.

Case Files of the Vermont Supreme Court Meeting in Franklin County

Book Description
Case files include all documents generated during the course of a supreme court trial, and may be extensive, minimal or nonexistent for any given case. They may include writs, affidavits, depositions, subpoenas, verdicts, pleas, motions, warrants, bonds, bills of costs, witness certificates, transcripts, findings of fact, master's reports, and documents relating to appeals, such as bills of exceptions. There may also be supporting documents such as deeds, promissory notes, statements and inventories. Franklin County court clerks arranged case files alphabetically by plaintiff for each court term, rather than by docket number. This order has been maintained. Each case is filed with the court term in which it ended. In a given court term, some cases reached a judgment or verdict, while other cases were ended by the plaintiff before judgment. The clerk separated judgments from discontinued cases, so case files are arranged for each term with judgments in alphabetical order, followed by discontinuances in alphabetical order. Miscellaneous supreme court files include court administration documents such as financial accounts, supreme court bar admissions, and instructions to the court clerk. Chancery court case files predating September 1840, and some 1840-1843 cases, are included with supreme court case files, since chancery court was part of the supreme court during this period.

Book Description
Prior to Sept. 1840, chancery court was held by the supreme court during its Franklin County sessions, so the chancery docket is included in supreme court docket books (see Series SUPR-FR-001). After Sept. 1840, chancery court was held as part of county court sessions, and its docket was recorded in a separate section of the county court docket for each term (see Series FRCC-001). Note that even after chancery cases were transferred to county court in 1840, the supreme court continued to hear some chancery cases up to 1843.

Record Books of the Vermont Supreme Court Meeting in Lamoille County

Book Description
Record books contain entries by the court clerk summarizing each case that ended in a judgment. Lamoille supreme court records cover the years 1840-1909, with some gaps. The recording of supreme court judgments was highly irregular. Only 1886-1909 entries are arranged consistently in chronological order by court term, in volumes exclusively limited to the supreme court. Because of the scattered nature of these records, and the lack of indexes for some volumes, the researcher must rely on the master General Index of County and Supreme Court Records to locate judgment entries for individual cases. The two master index volumes cover county court cases between 1836 and 1947, but post-1900 supreme court entries are incomplete. Index entries are arranged alphabetically by plaintiff for each court term, and include record book volumes, page numbers, case beginning and ending dates, and docket numbers. The indexes also include entries on discontinued cases, which are not included in the record books, but which may have case files. In addition to the two index volumes arranged by plaintiff, there is a set of index cards recording 1836-1968 county and supreme court cases by defendant. The cards are arranged alphabetically, but within each letter there is no alphabetical or chronological order of cases.
