La relative discrétion dont s'entoure la commune intention des parties en droit public tient sans doute de sa réduction à un simple instrument d'interprétation du contrat. Pourtant, une étude de son utilisation et des fonctions que lui assigne le juge administratif aboutit à l'ériger comme concept structurant du droit des contrats administratifs.Déclinaison de l'autonomie de la volonté, elle montre que le juge administratif est avant tout attaché à la protection des volontés réciproques des parties et à une conception du contrat commune au droit public et au droit privé.Mais le rôle de la commune intension en droit public ne se limite pas à une telle conception figée de la volonté des contractants. La nécessaire prise en compte de l'intérêt général par les parties suppose un travail d'adaptation par le juge, dont le point de départ reste toujours la commune intention. Elle a fourni la matrice originelle, quelque peu oubliée, de la mutabilité des contrats administratifs et sa plasticité lui promet un bel avenir, dans le contexte d'un contrat administratif arc-bouté autour de la loyauté contractuelle.

A careful examination of counter-terrorism campaigns outside the current "War on Terror," reveals that such national security efforts also have a complex, but often unexplored, relationship to gender.
