An Institutional And Normative Analysis of the World Trade Organization
Author: Mary E. Footer
Publisher: Martinus Nijhoff Publishers
ISBN: 9004149619
Category : Political Science
Languages : en
Pages : 401
Book Description
This book establishes a framework for analysis of the institutional and normative character of the WTO by locating the organization in a broader theory of international institutional law and in determining the basis for the conferral and exercise of powers in relation to its executive, legislative and adjudicative functions. The WTO is also read as an international regime in order to go beyond its formal legal and constitutional bases and to observe the Members' practice in the context of the former semi-institutionalised GATT treaty regime with which it retains strong links. WTO decision-making, which underpins and informs its institutional and normative acts, is analysed in order to better understand the dynamics of the organization. Normative developments in the WTO are reviewed from the perspective of the creation, maintenance and revision of legally binding and non-binding or 'soft' law norms, in the sense of principles, rules and standards contained in primary treaty rules, which set out the rights and obligations of the Members, and subsidiary rule-making activity by WTO bodies.

Rise and Demise of Commodity Agreements
Author: Marcelo Raffaelli
Publisher: Woodhead Publishing
ISBN: 9781855731790
Category : Business & Economics
Languages : en
Pages : 264
Book Description
A detailed examination is provided of the circumstances which led to the negotiation of each of the international commodity agreements with economic provision included since the end of World War II. How such agreements operated and the causes for difficulties in their implementation and the reasons for their failure is also discussed. It concentrates on four specific agreements; cocoa, coffee, sugar and tin; and as a contrast to these commodities a chapter is dedicated to OPEC. Written by an insider who was actually present at the 'creation', a first-hand view is given of how commodity agreements are actually arrived at during the course of negotiation and implementation.

The Genesis of the GATT
Author: Douglas A. Irwin
Publisher: Cambridge University Press
ISBN: 1139471341
Category : Law
Languages : en
Pages : 315
Book Description
This book is part of a wider project on the economic logic behind the General Agreement on Tariffs and Trade (GATT). This volume asks: What does the historical record indicate about the aims and objectives of the framers of the GATT? Where did the provisions of the GATT come from and how did they evolve through various international meetings and drafts? To what extent does the historical record provide support for one or more of the economic rationales for the GATT? This book examines the motivations and contributions of the two main framers of the GATT, the United States and the United Kingdom, as well as the smaller role of other countries. The framers desired a commercial agreement on trade practices as well as negotiated reductions in trade barriers. Both were sought as a way to expand international trade to promote world prosperity, restrict the use of discriminatory policies to reduce conflict over trade, and thereby establish economic foundations for maintaining world peace.
