Community and the Law

Community and the Law PDF Author: Takao Tanase
Publisher: Edward Elgar Publishing
ISBN: 1849803544
Category : Political Science
Languages : en
Pages : 217

Book Description
Takao Tanase seamlessly combines sociolegal and philosophical analysis as he explores the tensions between individual legal rights and communitarian values in settings ranging from post-divorce visitation rights to tort liability, lawyer client relationships, and rising litigation rates. Contrasting Japan with the individualistic thrust of American law, Tanase stresses the importance of building legal processes that encourage stronger social and communal bonds. Students of law and society on all continents will find rich food for thought in this intellectually bold and intriguing volume. Robert A. Kagan, University of California, Berkeley, US Takao Tanase s Community and the Law is a path breaking and often surprising interpretation of legal culture in Japan which includes subtle analyses of the changing role of lawyers and courts and the extent to which modernity and reliance on law are interlinked. But it is much more than that. His reflections on the different way law responds to social dilemmas in Japan and the USA are the building blocks of a much more ambitious project no less than constructing a coherent account of what law can and should do to maintain communal ties in postmodern times. The book is a pleasure to read for its learning and sophistication. Nottage and Wolff also deserve high praise for their light touch as editors and translators. David Nelken, University of Cardiff, UK and University of Macerata, Italy This important book translates seven landmark essays by one of Japan s most respected and influential legal thinkers. While Takao Tanase concedes that law might not matter as much in Japan as it does in the United States, in a provocative challenge to socio-legal researchers and comparative lawyers, he asks: why should it? The issue, he contends, is not whether law matters to society; it is how society matters to law. Developing a descriptive and normative theory of community and the law, the author directly challenges the view that legal liberalism represents the pinnacle of legal achievement. He criticises liberalism for destroying community in the United States and for offering false hope for a delayed modernity in Japan. By applying a distinctive interpretivist methodology, he constructs a communitarian model of law and society that serves as an alternative to legal liberalism. The book challenges conventional understandings of such legal sociological staples as torts, lawyers ethics, family law, human rights, constitutionalism and litigiousness. This fascinating book will prove a stimulating, thought provoking read for researchers and scholars of law, Japanese and American studies, sociology and jurisprudence.

Mapping Out the Research-policy Matrix

Mapping Out the Research-policy Matrix PDF Author: Germán Solinís
Publisher: UNESCO
ISBN: 9231041762
Category : Social Science
Languages : en
Pages : 246

Book Description
Social science research provides not only abstract, conceptual knowledge about society but also concrete, instrumental knowledge. It enables us to take action to recompose the world we live in. However, this book rejects narrow and simplistic conceptions of research use and its impact on policy-making, to embrace a more complex approach to seeing and dealing with social science. In the paradigm of "evidence-based policy", "evidence" is understood in its broad sense as information that helps form policies. Nonetheless, within current practices and discourse, it is not clear what "information" is, what is really meant by "evidence", and how it can be obtained objectively. The book draws on papers presented at the International Forum on the Social Science-Policy Nexus, where experts examined current practices and problems in areas such as social policy, migration, urban policies and globalisation. The Forum set a precedent in terms of dialogue between researchers and policy-makers. The authors contribute to enriching and elucidating the most common conceptualisations of the research-policy nexus. They represent a rich diversity of views, although most agree that an effective strategy to enhance social science-policy linkages should be underpinned by a theoretical and methodological framework that takes into account the interplay of different social actors.

Hedge Fund Activism in Japan

Hedge Fund Activism in Japan PDF Author: John Buchanan
Publisher: Cambridge University Press
ISBN: 1107379318
Category : Business & Economics
Languages : en
Pages : 389

Book Description
Hedge fund activism is an expression of shareholder primacy, an idea that has come to dominate discussion of corporate governance theory and practice worldwide over the past two decades. This book provides a thorough examination of public and often confrontational hedge fund activism in Japan in the period between 2001 and the full onset of the global financial crisis in 2008. In Japan this shareholder-centric conception of the company espoused by activist hedge funds clashed with the alternative Japanese conception of the company as an enduring organisation or a 'community'. By analysing this clash, the book derives a fresh view of the practices underpinning corporate governance in Japan and offers suggestions regarding the validity of the shareholder primacy ideas currently at the heart of US and UK beliefs about the purpose of the firm.

Assessing Student Outcomes - Why, Who, What, How?

Assessing Student Outcomes - Why, Who, What, How? PDF Author: J. Fredericks Volkwein
Publisher: John Wiley & Sons
ISBN: 1118279174
Category : Education
Languages : en
Pages : 158

Book Description
This volume offers administrators and practitioners a summary guide to assessment in higher education, from the reasons for undertaking assessment to the delivery of findings. It opens with the questions that precede an effective study and drive research design: To what extent is the study aimed at educational improvement, and to what extent is it aimed at external accountability? Are the results expected to demonstrate goal attainment, improvement, comparison to others, meeting standards, cost-effective investment? What is the population from whom assessment data are being collected: Are we measuring the knowledge and skills of individuals and making decisions about their remediation, certification, or development? Or are we sampling from particular groups of students and comparing them to each other, or perhaps to themselves over time? The core of the volume is devoted to the objects of assessment: basic skills, general education knowledge, attainment in the major, personal growth, attitudes and satisfaction, and alumni outcomes, keeping in mind both cognitive and noncognitive measures. One chapter describes common obstacles to effective assessment; others describe conceptual models, research methods, and data collection strategies and instruments. The concluding chapter underscores the importance of communicating research results effectively. This is a special volume of the Jossey-Bass higher education quarterly report series New Directions for Institutional Research. Always timely and comprehensive, New Directions for Institutional Research provides planners and administrators in all types of academic institutions with guidelines in such areas as resource coordination, information analysis, program evaluation, and institutional management.

Groundwater as a Key for Adaptation to Changing Climate and Society

Groundwater as a Key for Adaptation to Changing Climate and Society PDF Author: Makoto Taniguchi
Publisher: Springer
ISBN: 4431549684
Category : Technology & Engineering
Languages : en
Pages : 155

Book Description
The book presents an overview of recent advances in knowledge related to the assessment and management of groundwater resources, giving special attention to the uncertainties related to climate change and variability. While proposing strategies of groundwater management as adaptation, alternative and resilience under the changing environments, this book also discusses new directions and initiatives of hydrological study, in particular on the groundwater. Groundwater is a major source of water across much of the world, and acts as a component of the global water cycle on the Earth. Groundwater has the capacity to balance large swings in precipitation and has the potential to supplement surface-water resources when they are close to the limits of sustainability such as during drought. Although groundwater is pivotal to sustain water supplies, these important resources are vulnerable to increased human activities and the uncertain consequences of climate change. This book presents that groundwater with longer resident time of water circulation can be an alternative water resources and environment in changing climate. Assessments of groundwater services and benefit as well as risk are important for sustainable groundwater uses under the climate change. Groundwater which is one of the leys of adaptation to climate change should be treated as common resources and environment beyond the tragedy of the commons and dilemma of the boundaries. While providing a comprehensive description of hydrogeological characteristics of groundwater systems, the present volume also covers important aspects of legal and institutional contexts required for groundwater resources management as well as social and economic considerations. This publication may contribute to an improved understanding of the impacts of climate change and human activity on groundwater resources, provides useful guidance for policy makers and planners to include groundwater into climate change adaptation schemes and strategies.
