This is the first book on land administration and reform in Sub-Saharan Africa, and is highly relevant to all developing countries around the world. It provides simple practical steps to turn the hugely controversial subject of "land grabs� into a development opportunity by improving land governance to reduce the risks of dispossessing poor landholders while ensuring mutually beneficial investors’ deals. The book shows how Sub Saharan Africa can leverage its abundant and highly valuable natural resources to eradicate poverty by improving land governance through a ten point program to scale up policy reforms and investments at a cost of USD 4.5 billion. Debate on the role of land reforms in the economic growth of developing countries has been on for a long time without firm consensus. However, the apparent failure of the 'IMF-market-driven' based economic reforms and policies to deliver quickly the much needed equitable economic growth seem to have accelerated demands for broadening of development strategies to include it. In this dissertation, the author attempts to analyze the impact of land reforms in the economic growth in developing countries. It is argued that land reforms that provide for efficient land administration and land registration system creates a framework for definition of property rights and land tenure security through issuance of land titles. It is further argued that this creates investment incentives; promotes efficiency; increases collateral value and other sector-wide externalities that promote economic growth. Using data from Uganda, the author tested the hypothesis that: “land reforms positively contribute to a country's economic growth”. The evidence presented suggests a positive statistical significant relationship between land reforms and economic growth as approximated by: a) collateral value of a title and access to the credit market (Domestic credit to private sector); b) impact of land tenure security on investment and; c) FDI (control variable). However, the impact of urbanisation (a proxy for allocative efficiency) on economic growth was negative, contrary to the earlier expectation. This may not be considered a surprise result given the high levels of urban unemployment in Uganda. The general conclusion however is that for land reform to be effective, it should be accompanied by a wide range of other programmes such as development of appropriate rural infrastructure, reform of credit institutions, marketing facilities and new technologies as a comprehensive development policy.

Increased global demand for land posits the need for well-designed country-level land policies to protect long-held rights, facilitate land access and address any constraints that land policy may pose for broader growth. While the implementation of land reforms can be a lengthy process, the need to swiftly identify key land policy challenges and devise responses that allow the monitoring of progress, in a way that minimizes conflicts and supports broader development goals, is clear. The Land Governance Assessment Framework (LGAF) makes a substantive contribution to the land sector by providing a quick and innovative tool to monitor land governance at the country level. The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. This book examines issues at the forefront of the debate on land law reform, pays particular attention to how reform options affect the poor and disadvantaged, and recommends strategies for alleviating poverty more effectively through land law reform. It reviews the role of the World Bank in land law reform, examining issues of process as well as substance. It also identifies key challenges and directions, and stresses the need to design law reforms in ways that suit diverse economic, legal, and institutional environments. This book is a contribution to comparative thinking on reform of the law relating to land. It examines the implications for land law reform in the broadening of development goals beyond growth to include environmental protection, poverty eradication, and achievement of gender equity, and it reviews a broad range of experience in land law reform. After the introductory chapter, chapter 2 examines how land law reform is achieved through World Bank initiatives. It reviews steps the Bank has taken to achieve comprehensive reforms of land law in the context of natural resource management and land reform programs and land administration projects.
