Constitucionalismo crítico

Constitucionalismo crítico PDF Author: Diego Valadés
Publisher: Siglo XXI Editores México
ISBN: 6070311310
Category : Law
Languages : es
Pages : 153

Book Description

Decolonizing Constitutionalism

Decolonizing Constitutionalism PDF Author: Boaventura de Sousa Santos
Publisher: Taylor & Francis
ISBN: 1000914097
Category : Political Science
Languages : en
Pages : 355

Book Description
The modern state, law, and constitution result from a legal canon that (re)produces the abyssal lines dividing the world that is validated from the world whose humanity and epistemological validity are denied. This book aims to contribute to a post-abyssal reflection on law and constitutionalism by considering the structural axes of power that are constitutive of modern law “capitalism, colonialism, and heteropatriarchy” alongside the legal plurality of the world. Is it possible to decolonize, decommodify, and depatriarchalize the constitution? The authors speak from multiple geographies, raise different questions, resort to differentiated theoretical approaches, and reveal varying levels of optimism about the possibilities of transforming constitutions. The readers are confronted with critical perspectives on the Eurocentric legal canon, as well as with the recognition of anti-capitalist, anti-colonial, and anti-patriarchal legal experiences. The horizon of this publication is the expansion of the possibilities of legal and political imagination.

Critical theory and sociological theory

Critical theory and sociological theory PDF Author: Darrow Schecter
Publisher: Manchester University Press
ISBN: 1526105861
Category : Philosophy
Languages : en
Pages : 356

Book Description
Democracy in the twenty-first century faces a number of major challenges, populism, neoliberalism and globalisation being three of the most prominent. This book examines such challenges by investigating how the conditions of democratic statehood have been altered at several key historical intervals since 1945. It demonstrates that the formal mechanisms of democratic statehood, such as elections, have always been complemented by civic, cultural, educational, socio-economic and constitutional institutions that mediate between citizens and state authority. Rearticulating critical theory with a contemporary focus, the book shows why a sociological approach is urgently needed to address conceptual deficits and explain how the formal mechanisms of democratic statehood need to be complemented and updated in new ways today.

Research Handbook on Global Climate Constitutionalism

Research Handbook on Global Climate Constitutionalism PDF Author: Jordi Jaria-Manzano
Publisher: Edward Elgar Publishing
ISBN: 1788115813
Category : Law
Languages : en
Pages : 352

Book Description
Climate change is causing traditional political and legal concepts to be revisited. The emergence of a global polity through physical, economic and social interaction demands global responses which should be founded upon new principles and which cannot simply be modelled on traditional constitutionalism centred on the nation-state. This Research Handbook explores how to build this climate constitutionalism at a global level, starting from the narrative of Anthropocene and its implications for law. It provides a critical approach to global environmental constitutionalism, analysing the problems of sustainability and global equity which are entwined with the causes and consequences of climate change. The Handbook explores how to develop constitutional discourses and strategies to address these issues, and thereby tackle the negative effects of climate change whilst also advancing a more sustainable, equitable and responsible global society.

The Max Planck Handbooks in European Public Law

The Max Planck Handbooks in European Public Law PDF Author: Armin von Bogdandy
Publisher: Oxford University Press
ISBN: 019103987X
Category : Law
Languages : en
Pages : 769

Book Description
The Max Planck Handbooks in European Public Law describe and analyze public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, the series aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series began this enterprise with an appraisal of the evolution of the state and its administration, offering both cross-cutting contributions and specific country reports. This second volume continues this approach with an in-depth appraisal of the foundations of the constitutional order in various and diverse European countries. Fourteen country reports investigate the antecedents, foundations, organization, basic principles, and challenges to European constitutions. They include countries with long-lasting and recently amended constitutions, decentralized or unitary, with different political systems and institutional settings. In keeping with the focus on a diverse but unified legal space, each report also details how the constitutional identity of each country has been elaborated and what it entails. Together, the chapters of this volume provide a strong and diverse foundation for a continuing European constitutional dialogue.
