This publication contains an article by Dr Richard Kirkham, Lecturer in the School of Law at Sheffield University, on the history of the post of Parliamentary Ombudsman to mark the 40th anniversary of its establishment, together with a foreword written by the current postholder, Ann Abraham. The paper discusses the origins of the Office and its creation through the Parliamentary Commissioner Act 1967, as well as its existing and future role, the changing landscape of the administrative justice system and possible amendments to Office's powers. The paper concludes that "a few required amendments aside, the Parliamentary Commissioner Act remains a good piece of legislation and the constitution is much stronger for the Parliamentary Ombudsman. As well as improving the power of the citizen to gain redress, as was originally intended, Parliament itself has gained a valuable tool in the ongoing process of calling the government to account."

During the year the Ombudsman received 2,139 complaints, an increase of 24 per cent on the previous year and the highest figure on record. 1,988 complaints, including 195 statutory investigations, were settled, with seven fewer staff. The average time to conduct an investigation concluded by the issue of a statutory report was 52 weeks. The Ombudsman notes the greater involvement of other investigatory bodies, courts, and Government enquiries in his investigations, a situation that can cause extra delay. In the area of freedom of information, the Government's rejection of a recommendation by the Ombudsman is seen as a cause for concern, especially given the fact that the statutory right of individual access to information held by public bodies will not come into effect until January 2002. Until that date, the Ombudsman retains responsibility for considering complaints under the non-statutory code of practice, and the Ombudsman reports an increasing lack of co-operation from departments, calling into question the authority and standing of the office. The report also welcomes the proposed unified ombudsman scheme for central and local government and the NHS, as a means of removing the present cumbersome and restrictive methods of work imposed by the Parliamentary Commissioner Act 1967, though it notes that no firm proposals for the powers and accountability of the new body have yet appeared. Other sections of the report deal with investigated cases in the Department for Work and Pensions, other departments, and access to official information.
