Après l'explosion de mai 68, la remise en cause de la médicalisation des conflits de la vie quotidienne et le développement de l'antipsychiatrie, l'usage de la psychiatrie à des fins politiques fut dénoncé par de nombreux professionnels. Parallèlement, on a vu naître, s'affermir et se développer un mouvement européen de défense des droits des patients et usagers de la psychiatrie. Aussi, il paraît aujourd'hui nécessaire non seulement de réaliser une synthèse des principes à l'œuvre comme de la jurisprudence acquise, mais encore d'analyser un tel phénomène en le replaçant dans le débat d'idées de ces trente dernières années, pour permettre à tous de s'interroger sur l'évolution en marche et pour donner à chacun les moyens utiles à sa défense. Cet ouvrage met en évidence les fondements des principaux systèmes législatifs européens concernant l'hospitalisation, le traitement, la vie hors de l'hôpital, le suivi des malades mentaux, l'organisation générale du soin psychiatrique, dans leurs rapports, souvent complexes, avec le traitement de la dangerosité et le maintien de l'ordre public. Les auteurs, investis depuis plus de vingt ans dans la défense des droits des patients tant en France qu'au niveau international, livrent ici de nombreuses données inédites issues de la pratique, jusque-là peu connues même dans les milieux spécialisés.
