Book Description
Organization and Operations of Federal Credit Unions - Underserved Areas (IRPS 08-2) (US National Credit Union Administration Regulation) (NCUA) (2018 Edition) The Law Library presents the complete text of the Organization and Operations of Federal Credit Unions - Underserved Areas (IRPS 08-2) (US National Credit Union Administration Regulation) (NCUA) (2018 Edition). Updated as of May 29, 2018 NCUA is adopting a final rule implementing four modifications to its Chartering and Field of Membership Manual to update and clarify the process of approving credit union service to "underserved areas." First, the rule clarifies the procedure for establishing that an "underserved area" qualifies as a local community. Second, it makes explicit the process for applying the economic distress criteria that determine whether an area combining multiple geographic units is sufficiently "distressed" to qualify as "underserved." Third, it updates the documentation and clarifies the scope requirements for demonstrating that a proposed area has "significant unmet needs" for loans and financial services. Finally, the rule utilizes data provided by NCUA on the location of depository institution facilities to determine whether an area is "underserved by other depository institutions" according to the presence of their facilities within the area. Book Description
Credit Union Service Organizations (US National Credit Union Administration Regulation) (NCUA) (2018 Edition) The Law Library presents the complete text of the Credit Union Service Organizations (US National Credit Union Administration Regulation) (NCUA) (2018 Edition). Updated as of May 29, 2018 NCUA is issuing a final rule to amend its credit union service organization (CUSO) regulation to increase transparency and address certain safety and soundness concerns. The final rule expands the requirements of the CUSO regulation that apply to federally insured, state-chartered credit unions (FISCUs) to address accounting, financial statements, and audits. The final rule also includes limits on the ability of "less than adequately capitalized" FISCUs to recapitalize their CUSOs. In addition, it adds several new requirements that apply to both federal credit unions (FCUs) and FISCUs. Specifically, all CUSOs are required to annually provide basic profile information to NCUA and the appropriate state supervisory authority (SSA). CUSOs engaging in certain complex or high-risk activities are required to additionally report more detailed information, including audited financial statements and general customer information. The final rule also requires all subsidiary CUSOs to follow applicable laws and regulations. Book Description
Corporate Credit Unions (US National Credit Union Administration Regulation) (NCUA) (2018 Edition) The Law Library presents the complete text of the Corporate Credit Unions (US National Credit Union Administration Regulation) (NCUA) (2018 Edition). Updated as of May 29, 2018 NCUA is issuing final amendments to its rule governing corporate credit unions. The major revisions involve corporate credit union capital, investments, asset-liability management, governance, and credit union service organization (CUSO) activities. The amendments establish a new capital scheme, including risk-based capital requirements; impose new prompt corrective action requirements; place various new limits on corporate investments; impose new asset-liability management controls; amend some corporate governance provisions; and limit a corporate CUSO to categories of services preapproved by NCUA. In addition, this rulemaking contains conforming amendments to rules governing Prompt Corrective Action (for natural person credit unions); Investments and Deposit Activities (for federal credit unions); Administrative Actions, Adjudicative Hearings, Rules of Practice and Procedure, and Investigations; and Involuntary Liquidation of Federal Credit Unions and Adjudication of Creditor Claims Involving Federally Insured Credit Unions. These amendments will strengthen individual corporates and the corporate credit union system as a whole. Book Description
Community Development Revolving Loan Fund Access for Credit Unions (US National Credit Union Administration Regulation) (NCUA) (2018 Edition) The Law Library presents the complete text of the Community Development Revolving Loan Fund Access for Credit Unions (US National Credit Union Administration Regulation) (NCUA) (2018 Edition). Updated as of May 29, 2018 NCUA is issuing a final rule to change its regulation governing the process by which the agency solicits, receives, evaluates, and acts on credit union applications for loans and technical assistance grants from the Community Development Revolving Loan Fund (CDRLF or Fund). The changes update the rule to increase transparency and are intended to improve its organization, structure, and ease of use by credit unions. The revisions do not reflect a change to the fundamental mission of the CDRLF, but instead remove unnecessary detail and outdated processes in the regulation while adding clarification and flexibility. The final rule also clarifies the application process and adds requirements addressing reporting and monitoring.
