The Impact of eConveyancing on Title Registration

The Impact of eConveyancing on Title Registration PDF Author: Gabriel Brennan
Publisher: Springer
ISBN: 3319103415
Category : Law
Languages : en
Pages : 331

Book Description
This work is an assessment of how to manage risk in property transactions in the context of the move from paper-based to electronic conveyancing (eConveyancing). In particular the focus is on risks that impact on title registration, and the security, protection or lack thereof that this registration offers to land owners, third parties and property claimants. The impact is the extent to which a change in the transactional process may unintentionally affect risk (being the consequence of change and the likelihood of that consequence having a negative effect). The risks are identified, analysed and evaluated against the backdrop of title registration and the development of eConveyancing through a comparative analysis of the systems in Ireland and Ontario, while also referencing other developing electronic systems around the globe.

Megacity Malaise

Megacity Malaise PDF Author: Carlo Fanelli
Publisher: Fernwood Publishing
ISBN: 155266838X
Category : Political Science
Languages : en
Pages : 155

Book Description
“[A] political economist with a gift– due to his not having forgotten his working class background– for bringing complex economic problems down to their real world implications for working people.” - Jeff Noonan Megacity Malaise documents how municipal governance, labour-management relations and public services have been transformed during the postwar period. Carlo Fanelli begins with an analysis of neoliberalism, exposing the underlying social and political causes of urban fiscal crises. Fanelli shows how municipal finances have been eroded to justify the policies of permanent austerity, which has led to a deterioration of public services and demands for concessions from civic workers based on the contention that they are unaffordable. Focusing on the post-amalgamation era at the city of Toronto, Fanelli draws on his experiences as a former city worker and trade unionist to make the case that a new municipal agenda infused with a sense of social and workplace justice is necessary to overcome mounting registers of social inequality. Alternative approaches to public policy must be rooted in a political project that challenges the continued reliance on tax cuts as a cure for nearly all of society’s social ills and municipal governance that rejects the marketization of everyday life.

Secured Transactions Law Reform

Secured Transactions Law Reform PDF Author: Louise Gullifer
Publisher: Bloomsbury Publishing
ISBN: 1509903127
Category : Law
Languages : en
Pages : 616

Book Description
Secured transactions law has been subjected to a close scrutiny over the last two decades. One of the main reasons for this is the importance of availability of credit and the consequent need to reform collateral laws in order to improve access to finance. The ability to give security effectively influences not only the cost of credit but also, in some cases, whether credit will be available at all. This requires rules that are transparent and readily accessible to non-lawyers as well as rules that recognise the needs of small and medium-sized enterprises. This book critically engages with the challenges posed by inefficient secured credit laws. It offers a comparative analysis of the reasons and the needs for a secured transactions law reform, as well as discussion of the steps taken in many common law, civil law and mixed law jurisdictions. The book, written under the auspices of the Secured Transactions Law Reform Project, informs the debate about reform and advances novel arguments written by world renowned experts that will build upon the existing literature, and as such will be of interest to academics, legal practitioners and the judiciary involved in secured transactions law around the world. The text considers reform initiatives that have taken place up to the end of April 2016. It has not been possible to incorporate events since then into the discussion. However, notable developments include the banks decree passed by the Italian Government on 29th June 2016, and the adoption of the Model Law on Secured Transactions by UNCITRAL on 1st July 2016.
