Los retos que ha impuesto el uso de las nuevas tecnologías en las relaciones laborales suponen el desafío de adecuar las clásicas instituciones del derecho del trabajo a la nueva realidad que emerge como consecuencia de la irrupción tecnológica. Este desafío no se limita a la discusié6n vigente acerca de la naturaleza jurídica del trabajo que se presta a través de plataformas digitales, discusión que, por demás, resulta de una gran trascendencia en la medida en que define -o redefine— las fronteras del derecho laboral para incluir 0 excluir esta nueva modalidad de trabajo de la aplicación de las tutelas propias de esta rama del derecho. Conscientes de esta realidad surge la idea de adelantar esta investigación, que ahonda en la incidencia de las nuevas tecnologías en algunos de los aspectos que se consideraron de particular importancia en la relación laboral: el ejercicio de la subordinación, el derecho a la desconexión de los trabajadores, el derecho a la intimidad o el estrés laboral como factor presente en las organizaciones contemporáneas; esto, sin dejar de lado, por supuesto, la prestación de servicios a través de las plataformas tecnológicas. Este libro pretende contribuir con el debate, aportando la visión de los autores en los distintos temas que se trataron a lo largo de los capítulos que lo componen y teniendo como insumo importante algunas decisiones judiciales que se han pronunciado acerca de los temas objeto de investigación desde una perspectiva no solo local, sino también regional y acorde con la normatividad internacional.

This book was published in 2003.This book offers a broad and incisive analysis of the governance of privacy protection with regard to personal information in contemporary advanced industrial states. Based on research across many countries, it discusses the goals of privacy protection policy and the changing discourse surrounding the privacy issue, concerning risk, trust and social values. It analyzes at length the contemporary policy instruments that together comprise the inventory of possible solutions to the problem of privacy protection. It argues that privacy protection depends upon an integration of these instruments, but that any country's efforts are inescapably linked with the actions of others that operate outside its borders. The book concludes that, in a ’globalizing’ world, this regulatory interdependence could lead either to a search for the highest possible standard of privacy protection, or to competitive deregulation, or to a more complex outcome reflecting the nature of the issue and its policy responses.
